Today I'm going to be installing this RCA Yagi HD antenna model number ANT751Z
It's not a sponsored video I got this thing off of Amazon because it had like
I don't know 7,000 reviews or something. So today we're going to see how it works.
This is an HD over-the-air (OTA) broadcast television antenna for a cord cutter to start cord cutting

So this is what the completed RCA ANT751Z antenna looks like.
Alright so the part that we're gonna do on the ground is done now it's time to jump on the roof
You've got to make sure the mast is level
Now you got to use a compass to point it in the right direction
Alright the antenna is on the roof it's pointed in the direction that the
internet says is right for my house to get the most channels and now we're
scanning four channels. It found 117 channels which is way more than I found
with this indoor 1byone antenna but that doesn't necessarily mean that these are
good channels and washable channels they could just be a bunch of foreign
channels that I can't understand so go look at that. As I suspected most of the
stations are foreign but I get CBS, NBC, ABC, FOX and a couple other important
local channels so that was really what I was after this RCA ANT 751 outdoor
antenna seems to be rocking it. The picture looks great although you're
watching it on YouTube so it's probably can't really tell but it looks fantastic
and I'm super pleased with this thing

Colourpop Semi Precious Eyeshadow Palette: Swatches, Full Review and Demo - Duration: 10:42.
everybody welcome back to my channel so today's high-end makeup review is on the
colour-pop semi-precious palette so if you'd like to see full swatches a little

colour-pop in my April's boxy charm I know some people don't consider color
pop to be high-end I do guys this palette does retail for $26 okay you get
eight shades they are beautiful shades not gonna say they're not but yeah eight
shades for 26 bucks to me that's pricey but I do know that they do have
affordable makeup this is the first color pop product I have tried so guys
like I said this is the semi precious palette you get eight shades they are 20
grams each so the whole entire palette is 16 grams or 0.56 ounces of product
okay guys this is cruelty free it's made in the United States so yeah okay guys
so let's go ahead and do some swatches shall we okay there's no mirror which is
fine okay but we have this first shade right here and this is celestial
beautiful okay guys this kind of blue shade is called beam me up what it's
beautiful too I mean they're they're all really really pretty really really
pretty shades K this red one is called easy go crazy pigmentation guys this
copper one is called up and Adam mm-hmm down here guys we have Weststar
it's kind of like a chocolatey brown shade this green one is called bashful
okay then we have upon a star which is kind of like a pretty kind of almost
like a rose gold ma B shade it's beautiful and then the last one guys is
called the game so guys that is all eight shades watched guides really
creamy really buttery guys all the shades are shimmery metallic shades okay
so guys for so personally this might not be a standalone palette for a lot of
people if you're doing it very simple I look and use a little bit of shimmer
across the eyelid then you can definitely just use the semi-precious
palette but guys super super beautiful pigmented creamy beautiful shades really
really pretty okay so guys I'm gonna go ahead and do start doing a look guys I
okay I am going to do something kind of fun so I think I'm gonna go ahead and
use this red shade I'm just gonna be starting with a dry flat brush okay and
my eyelids are primed and everything just kind of scooch in close okay so
it's just Dipper in right there just gently patting because I don't want
there to be a whole bunch of fallout okay so let's just go ahead and I'm
gonna start towards the center of the eyelid and work my way out okay guys
once again this is a dry brush so guys it is crazy crazy pigmented so so pretty
I mean can you please not to drive I brush I mean I know all of us know to go
ahead and use a damp brush when it comes to shimmer shades but this is just so
crazy ly pigmented it's so beautiful I
mean there are really a nice big pan size too so it's also pretty I have to
say but this being my first color pop experience I'm very very pleased they're
really really beautiful shadows for sure do I think it's worth $26 yeah honestly
I do I've worn this before not the shade but I've used this palette and guys I
always prime my lids using concealer and setting with powder and this stuff
lasted forever I think I'm gonna go ahead and go in with celestial this kind
of gold shade right here and I'm going to just turn my brush over that's gonna
go in our inner corner I think these would be the perfect shadows if you are
wanting to do kind of like a cut crease and you want something like really
pretty and something that will stand out and guys I mean this is just amazing kay
I mean you guys see how harsh it is on this eye that line where I put that red
shadow guys you barely have to kind of run over it and it just almost blends
itself so so pretty but you guys you can do a really really fast easy look very
very quickly it's all spending too much time and it's just give such a beautiful
look
I'm gonna go ahead and go in with a matte shade so I'm not pulling another
eye shadow paladin or anything like that I'm just gonna be I know it's guys it's
a huge shot gonna be going in with my Physicians Formula butter bronzer and
I'm just going to just gently place that into my crease just to kind of get that
blended now this really is just such a beautiful palette I'm really really
happy that I got to try this semi-precious palette as my first color
pop experience because guys I am not disappointed at all at all
it is stunning guys like I am blending I'm not gonna say right on top of it but
you know I'm obviously putting a shade into my crease area you obviously get a
tiny bit of shadow into that crease area and guys the pigment stays true it
blends beautifully and it just gives a beautiful look so easy and guys you want
to know the best thing about it I was on colourpop's website and guys the
semiprecious fella it's actually on sale right now so you're not gonna spend $26
on it it's less than 20 so if you want to pick
up this semi precious palette guys because absolutely beautiful I don't
think you'll be disappointed guys not only does a swatch beautiful ek I mean
obviously those swatches are just killing it okay just beautiful okay but
guys it it applies and wears beautifully on the eyes and that's the important
thing right and it totally does I did check last week and like I said this was
on sale for less than 20 I don't know what it is right now definitely go check
it out so if you are looking for a nice beautiful vibrant shimmer palette I
think you would really enjoy the color pop semi-precious I'm glad I got to try
it in a beauty box but I'm definitely going to be researching and maybe
purchasing some color pop products I've heard their concealers are amazing so
I'm really really pleased with this eyeshadow palette I think is stunning
it's beautiful it's easy to work with you can just throw a couple of matte
shades into your crease or like I said you can definitely use one of these
lighter shades and just pop it all over the lid and just use your fingers to
blend it it would be a beautiful simple like very pretty look so you know
whatever you would like to do but guys they are just beautiful and stunning and
yeah I love this palette so guys I really hope you enjoyed this video if

because some hair products, skin care products, and cosmetic products are rubbing alcohol
not all products tho
However, we have two kinds of alcohol
one is fatty alcohol which is good for your skin and hair
the other one is short-chain alcohol which can create dry and damage for your hair and skin
this curling cream from CANTU is rubbing alcohol but it is fatty alcohol
the alcohol is STEARYL ALCOHOL
which give a smooth, soft feeling to the hair shaft by helping the cuticle to lie on the surface of the hair
and keep safe the product
HOWEVER!!
this product is rubbing alcohol which make u hair dry and damage
ISOPROPYL ALCOHOL is same as hand sanitizer
I don't mean I wanted buy this product
I was looking for shea moisture leave in conditioner that I always use
but I couldn't find it on beauty supply and wall green, anywhere then
so I bought this CANTU product without any reviews and rumor
after I bought , I checked the reviews on the internet and youtube, and there're so many haters lol

Is It Ever Okay to Lie? (Lying by Sam Harris Book Review) - Duration: 15:13.
is lying ever okay well that's exactly what we're gonna be talking about in
this video so make sure that you stay tuned what is up everybody this is Chris
from the rewired soul where we talk about the problem but focus on the
solution and this is another mental health book review I've been really
getting into Sam Harris lately it has a very short book very short book called
lying ok like it's so short that I got the audible version and it's like an
hour and 15 minutes and it's only 5 bucks so it is definitely worth your
time so in this book he talks about is it morally or ethically ever right to
lie all right so it's a great great great great book that you need to check
out all right so as you can see I'm kind of excited and jazzed up about this this
is a topic that I am so so passionate about and the reason being for over 20
years of my life lying was probably the biggest part of my personality so if
you're the child of an alcoholic or addict parent one of the key symptoms of
children of alcoholic or addict parents is that we lie when it would often be
easier to just tell the truth it's part of our DNA I'll make more videos about
why that happens but I was constantly lying most of my life not only was it
causing more suffering to myself and my mental health but it was also increasing
the suffering of everybody around me since working on my mental health for
the last six years or so it has been so important for me to tell the truth as
much as possible I would be lying to you right now if I told you that I've been a
hundred percent truthful all the time but it is close to I'd say 90 to 95
percent there are still parts of my character that spring up every now and
then for example I was just at the gym and I was actually listening to this
book while at the gym and my best friend he was calling me and I sent him one of
those quick reply messages on the iPhone and it said can't talk right now I'm
working or call or text you later but replied afterwards and I was like hey
man I'm at the gym I just did a quick reply you know what I mean so if I do
catch myself being untruthful like 99% of the time I'm being honest but this
book helped open my eyes about the other little aspects I can really work on to
improve my mental health this is 100% a mental health issue I've
done another video which I will link up in the info card about how long actually
fuels your anxiety like real quick recap on it when you tell a lie you build up
your own stress about are you going to get found lying can also fuel depression
one of the symptoms of depression is a lot of negative self-talk so for example
if you are someone who is constantly lying and deceiving people you are going
to beat yourself up and say I'm no good I am NOT a good person on costly line
fun fact I make half as much money as I used to make because I got out of the
sales industry I knew that I could not do that job and support myself as well
as my son if I was being honest all the time in that industry so this is very
very important I knew that it would make me depressed it would make me too
anxious and for me as a recovering drug addict that can lead me right back to
addiction so before I jump further into this book I really really hope two
things one is that you pick up this book these are the audible version or the
book copy okay the second thing is please share in this video please share
this video so we can work on creating more onus people and have better
communication better relationships and all that good stuff
all right so I'm gonna dive into a few topics from this book first and foremost
let's talk about what is a lie sam harris defines a lie as to intentionally
mislead others when they expect honest communication so he goes into a few
different topics about telling the truth and being truthful the difference
between those two things he also talks about secrets being different than
honesty he also talks about the difference between being deceitful and
lying okay like there's some little nuances in there that I think are very
interesting topics that he covers in this book real quick disclaimer before I
jump to a few of the examples Sam Harris does
a great job of saying even though it is morally correct to be honest as much as
possible you don't got to be a jerk about it okay
so I know people immediately like wow that would be rude to say that he gives
plenty of examples on how to be honest without hurting the other person's
feelings or minimizing the hurt that may be inflicted so the first one let's
cover let's cover the white lie to a friend it's more specifically let's talk
about not being truthful about their skills or their abilities by telling a
lie you are withholding the person's ability
to either a improve upon their skills or abilities or be completely switch paths
this is something I always have to do let's reverse the seats real quick what
I want a bunch of people telling me that my YouTube videos are amazing if they
sucked I might spend so much time and effort on this YouTube channel get no
following at all and be completely confused because nobody was telling me
the truth about my skills and abilities on YouTube now I'm also a writer if you
didn't know I got a couple books up in the Kindle Store now what if nobody ever
told me that I'm a terrible writer this could lead to me spending countless
countless hours some authors spent a ton a ton of time on their books and when
they're requesting feedback from friends colleagues family members if they're
being lied to when we publish that book we might face a ton of criticism and in
some cases we might ruin our reputation because we say things in the wrong way
by the way this is why you have an editor you see what I'm saying like we
can waste countless hours if people aren't honest with us about our skills
and our abilities sure it might hurt at first but what's the alternative
would I rather keep people in my life who I know are lying to me constantly
what else are they lying to me about can I ever value their opinion and this can
be rough like my girlfriend she's an amazing artist by the way follow her on
Instagram and sometimes she'll ask me what I think about her artwork and the
other day she actually asked like oh you know like I think the
proportion on the head is a little bit off but here's where you keep yourself
out of trouble like I am not necessarily her target audience either like I'm not
somebody who values art as much as some people so what I often tell people
especially when they ask me for honest feedback about their craft is I say that
I might not be the best judge of this specific scenario but when you keep
people around who are honest with you it actually improves a relationship because
here's the reason why here is the reason why that I can't
stress enough when that person gives you praise you know they are being honest
with you like for example I make sure to go out of my way to praise my girlfriend
when she makes stunning art that actually I'm just like whoa like I tell
her I'm jealous of her abilities and half the time she's like oh I didn't
even really like that one you know same thing happens to me when
you all actually like a video that I didn't think much of but I give praise
left and right and it lifts people's spirits up because they know that I'm
always being truthful with them next should you ever lie about an illness to
your friends and family members if you're somebody who has lost somebody in
your life maybe it's your parents grandparents friends whoever it is if
you've lost anybody to an illness that you did not see coming that they knew
about you already know the answer to this question I've personally been
dealing with this with my own father he's had some health issues since last
year last year the day of my birthday he had an open heart surgery and ever since
then like myself my sister my family we've all kind of been on edge my dad
has this ability to minimize everything okay and I told him is that you'd be
honest with me like why do you tell me if your health is deteriorating
then the hurt that I would feel by being completely caught off guard from you
dying and you knew that this was coming but you didn't tell me when we lie to
our loved ones about our health issues we are denying them the ability to show
us love and affection we are stripping them of that right and now the worst
question of them all that we all get at some point or another do I look fat now
Sam Harris brings up an excellent point when discussing this one he talks about
like the chances are that you know your audience you know your audience very
well what I mean by that is chances are you're not just walking down the street
and some random strangers gonna be like do I look fat like that never happened
so think about who your audience is for example is it your wife or husband
boyfriend girlfriend isn't one of these people okay something I often try to do
is like that's like what's the root what's the root of this question or they
just ask me if I love them or they ask me if I love them unconditionally right
are they asking me if I'm attracted to them or are they asking because they've
had some health issues lately or the doctor said something you know what I'm
saying like this helps me gauge my response to it and like for example I
going back to this whole role reversal thing anybody on planet Earth
ever came up to me and said Chris you're not overweight I would never ever ever
ever trust a single word that came out of their mouths like they are blatantly
lying to your face and as humans we wonder what else are they lying about
again disclaimer when answering this question honestly you don't have to be a
jerk about it another person who might ask you this is it like a friend right
is it a friend is it a family member you know them very well is this somebody who
is desperately looking for a relationship are they on the path to
trying to get married and start a family and are they asking you does this outfit
make me look fat right well again going back to the skills and abilities
question on should you lie to them like are you going to let your friend walk
out in public looking awful when they're trying to find a potential partner are
you really helping them or are you hurting them in this situation but
another way of talking to somebody about this is like this hey it's completely up
to you on who you're looking for yes there are men or women who prefer a
different type of physique than what you have so if you're looking for that type
of person then yeah maybe you might want to lose some weight but about that
empowerment though like I tell people straight up I'm like listen there are
people who might like your size right like that's totally correct and like
realtalk if you are looking for somebody who is purely only going to date you
based on your weight maybe they aren't the best person for you you know what
I'm saying so I'm very honest when it comes to even the topic of weight and
these are ways that you can talk about it in a safe way and is the person
talking to you or asking you about your weight because they're trying to get a
beachbody you know what I'm saying like again are they looking for a potential
mate I'd also ask like are they comfortable with their body because you
know truth be told if they're comfortable with their body do you think
go for yourself on the beach or at the pool like it's that simple like are you
happy with you anybody ever ask me about weight it's like are you comfortable
with yourself if not if you're not comfortable going out and you know a
bikini or a speedo or even like a bathing suit then yeah maybe you should
lose some weight so lastly women is it morally okay to lie basically what I
love about this book is Sam Harris literally suffocates every excuse to lie
except in two scenarios the first one is like a life-and-death situation okay
like if you're in war or if like a murderer is in your house or like just
crazy scenarios like that right like yes then it's okay to lie to preserve life
the other example that he talks about is if you lie would it do more harm than
good and the example given in this book is say a guy cheated on his wife years
ago okay he stopped the affair everything with his wife and his
children is going great and now he wants to be honest should he tell his wife
about the affair the answer being no okay reason being is because a lot of
people can be affected two marriages are involved right that persons as well as
the person he had a affair with also the kids lives are involved too so this is
something I often teach my clients too because sometimes we tell the truth just
to clear our own conscience and we don't think about the damage it can do to
other people if any of you are familiar with step 9 from 12-step programs you
know a lot more about this subject and basically what sam harris says as an
answer to this is if this is the new way of living that you're trying to have
start moving forward okay moving forward with this honesty so he
also covers a variety of other topics in this book like is it okay to lie to
children should you lie job interviews when you're desperate for a job and a
really interesting what I found is should you lie to somebody about
throwing them a surprise party this was very very interesting I really enjoyed
his answer on this one so Sam basically says the golden rule this is the golden
rule that I stand by as well is if the walls were reversed would you rather the
truth be told to you or along if you use that as your North Star or your rule of
thumb you will be set up for success and better relationships with others as well
as yourself and your mental health again please share this video please share

Hello! Yes, today it is the 1st of May and yes, the weather here is really shitty.
So I will talk to you a little about my helmet - a Shark Speed-R 2.
Let's get right into it.
As a helmet manufacturer, Shark is an intermediary one,
which means the helmets it produces are neither too cheap or too expensive,
somewhere in the upper spectrum of safety.
This helmet was designed to be used on naked and sports motorcycles.
That means it is very aerodynamically efficient when you ride it upright, in this position, on a naked bike,
or when you ride tucked in, in this position, with your chin on the tank, on a sports motorcycle.
The helmet has two active vents - one on the chin, on the lower side
and a larger one on the top of the head.
Both vents can be opened and closed.
On the back side, it has a spoiler that creates a low pressure area behind the helmet,
which helps extract all the hot air out of the helmet.
Smart stuff, ain't it?
The shield is pinlock ready - included in the box, which is really nice.
The helmet has a drop-down sun visor - that was one of the main conditions when I got it.
The sun visor looks like this and it can be lowered and retracted.
The mechanism is cable-operated and the lever that lowers the sun-visor is on the top of the head,
next to the big upper vent.
It is very easy to find it, even when riding, with a gloved hand, if you want to lower the sun visor.
It has a double D ring lock, which means it has two metal D-shaped rings to which the strap secures.
Opinions regarding the best locking system are split, but this is undoubtedly the safest one.
You cannot ride on the track without such a lock.
Furthermore, you can infinitely adjust it.
You can tighten the strap as far as you want, without depending on a predefined number of
increments that the locking mechanism has.
This helmet has a 4 star Sharp rating.
In case you didn't know, Sharp are an independent company who test and rate motorcycle helmets from 1 to 5.
1 being the lowest, least safe and 5 the maximum rating. As I said, this has a rating of 4.
I added a link to the Sharp website in the description, in case you want to see the rating on the helmet you have
or are planning to buy.
This helmet does it's job fairly well.
It's rather light, very well vented,
the pinlock does it job magnificently,
the drop-down sun visor is dark enough, so that you can ride even on a very bright day.
All that being said,
I would judge this to be a mediocre helmet, as a whole package.
And let me tell you why.
It is rather noisy,
It comes ready to have a Shark proprietary intercom (called sharktooth) installed.
In the back, under the neck roll, it has a cut-out in the EPS liner for the battery.
The intercom unit itself would be glued somewhere on the side of the helmet.
But the Shark intercom sucks - please do not buy it.
Spend a little extra money for a Sena or a Cardo intercom that you can later use on another helmet, too.
Furthermore, I absolutely hate the way the shield is mounted. Let me tell you why.
Instead of having detents, this one, as you can see...
goes up and down very smoothly.
This is adjusted by these screws on the side, which tighten into a channel
and determine how smooth or tough the shield movement will be.
But that's a very dumb system.
Because no matter how hard you tighten the screws, after 4-500 kilometers worth of opening and closing the shield,
they will get loose and the shield will no longer stay open.
Although you open it, the wind will slam it shut again.
So I always have to pack an Allen wrench.
Another design flaw is that, as the helmet is ready to have an intercom installed,
it has speaker cut-outs in the EPS liner.
These cut-outs are lined with a Velcro type material.
You stick the speaker to said material (the speaker also has Velcro on it)
After sticking the speaker, the material will become unstuck from the EPS,
so you will end up with an intercom speaker dangling inside the helmet.
Which is not really nice.
As I said earlier, the vents are very efficient for naked and sports motorcycles, on which there is not much wind protection.
But, after getting the GS, I noticed that this front vent
has the opening facing up.
This was no problem on the Hornet, as I was riding with the head slightly tilted and the air could come in.
Now, on the GS, with the windshield and all that,
the front vent has become very inefficient and I get kind of hot in the helmet.
As a conclusion: a 4 star Sharp rated helmet, very good for naked and sports bikes.
Light, but loud.
And with a few design flaws that will drive you nuts.

TCPA Case Review - Ricky R. Franklin v. Express Text - Duration: 36:01.
Derek: Hello, everyone.
Derek Johnson with tatango.com.
I'm here with Joe Bowser from Innovista Law, home of the TCPA Defense Force.
And we're trying something new.
We're trying to do a TCPA case review today, where we're gonna actually discuss what is
happening in the court systems with TCPA cases.
So, hey Joe.
How are you doing?
Joe: Doing well, Derek.
How are you?
Derek: Good, man.
Good.
I know we've done a few videos together, so it's always good to see you.
Joe: Likewise.
Derek: Okay.
So, the first case we're gonna review today, and you can find many other cases on our YouTube
channel, is a TCPA text messaging case, which was Ricky R. Franklin vs. Express Text.
And Express Text is a SMS software provider, correct?
Joe: Correct.
That's right.
Derek: Okay.
Perfect.
So, I'm gonna review kind of some of the basics, and then I'm pretty sure you have even more
information, and then we can discuss how this case impacts text message marketers.
So, what I have written down here, and kind of what I've, you know, summarized from this
case is, there's this person named Ricky Franklin.
And he received 115 text messages between July 2015 and September 2016.
So, about a year or so, he's been receiving a lot of text messages.
It looks like the...So, Express Text was the SMS software provider.
But the client of Express Text, the people sending the text messages, was WorldWin Events.
And so they hired Express Text to, you know, be their software provider.
So in September 2016, Franklin, so the consumer, responded "Help" to one of those messages
and received a response directing him to call Express Text to opt out of the messages, so
giving him like, you know, when you text "Help" to a short code and then it responds back,
like, "If you need help..."
So instead of...
Joe: And that's what he did.
Derek: Okay.
So he texted "Help."
Now, it didn't come back with a WorldWin message, it came back with a Express Text message saying,
"Please contact Express Text to opt out," right?
Joe: That's what happened.
Right.
And he did make that call.
Derek: Okay.
So, yeah.
I have that here, Express Text employee received the call and confirmed that this person, this
consumer, Rickey Franklin, had been removed from the company's database.
Now, do we know that that actually happened?
Joe: That seems to be undisputed.
Derek: Okay, okay.
Joe: What happened after that is he began then having a conversation with the platform,
where he would text things like, "hi" and "is this a real person behind these texts...answering
these text messages."
So he continued the conversation after he was opted out.
Derek: Okay.
So he opted out, most likely through the...he was called into Express Text and said, "Hey,
opt me out," they opted him out.
And then for some reason, he started texting into the shortcode again, asked, like saying
like, "Hi," and, "Is this a real person answering these text messages?" and that's kind of when
then...So explain to me where the violation of the TCPA kind of fell or why he thought,
you know, there was a violation.
Joe: He thought all of the message he got...he received were in violation of the act.
So he didn't care whether it was the ones where he claims he had no idea why he got
them and then the ones after he opted out.
For him, all of them were unsolicited messages that violated the act and entitled him to
damages.
Derek: Okay.
So this is the 115 text messages.
This is not him texting in and saying, "Hello," or, "Is this a real person answering this
text?" and then he would get one back like a response.
He was saying 115 were, you know, a TCPA violation or all of them, just every single one?
Joe: Every single message.
Derek: Okay.
Now, so what was kind of, you know, what was the result of this?
Did WorldWin and Express Text...I guess he was suing the text message provider, not WorldWin,
right?
Joe: Right.
He only sued Express Text.
Derek: Okay.
Why would a consumer do that instead of suing WorldWin Events?
Joe: Well, so he was there pro se, which is to say without an attorney.
So there may have been any number of factors that led him to only sue Express Text.
He might think that WorldWin doesn't have the money to back up any settlement or judgment
he might get.
It might be hard to get WorldWin into that same court such that he'd have to have two
different lawsuits about the same texts.
So if you think Express Text can foot the bill as it were, you don't add necessarily
the company who actually sent the messages.
He may have had a hard time finding out how to even serve them with process, with the
complaint and the summons.
Derek: Okay.
Interesting.
Joe: So, you know, getting a lawsuit off the ground does have some complicating factors,
and he might not have been able to thread the needle to get both Express Text and WorldWin
in the same case, in the same court.
Derek: Okay.
Because usually, at least from my experience and watching these court cases, is usually
the consumer is suing the brand, because usually the brand, let's say, you know, in one of
our other TCPA reviews we're gonna be reviewing Kohl's.
You know, Kohl's I would assume has more assets than a software provider like Express Text.
Joe: I would expect.
Derek: So it's usual brand.
But in this one, it seems like WorldWin might have been a smaller company and Express Text,
you know, was easier to get a hold of.
So they went after, you know, we presume the company that he thought had the most, you
know, exposure.
Joe: Right.
And WorldWin might have been a lead generator.
That's hard to pin down.
So you don't know what the circumstances were that led him to choose Express Text.
I have litigated against Ricky Franklin before.
He's reasonably aggressive.
So that's why I'm assuming he had a hard time putting those two in the same case.
Derek: Okay.
So is this Ricky Franklin person, is he an attorney or is he just representing himself
as a non-attorney?
Joe: He represents himself as a non-attorney.
Derek: Oh, okay.
I didn't know you could do that.
Joe: Yeah.
Sure, sure.
Derek: Okay.
Joe: I think, I mean, the courts are open to everyone.
And he's free to represent himself pro se.
This is probably his 10th TCPA case.
So he is very familiar with the TCPA.
He has a number of phones, and he keeps good track of who calls and who texts him.
And so, it comes as no surprise to me personally that he filed this case.
Derek: Okay.
So this whole case comes down to he sued under the TCPA.
And the TCPA, if you win, could be between $500 and $1,500 per text message that is received,
right?
Joe: Correct.
Well, actually you don't even have to receive them.
You'd...so you get...the liability attaches to the initiation.
So there are cases that show that calls that you didn't receive are still violative of
the act because, you know, the misdeed essentially is to attempt the call, to initiate the call.
Derek: So if it's like even like if a spam blocker, you know, blocks the spam, you still,
even though you didn't get the message, you still actually could, you know, have a judgment
against the person that sent the spam?
Joe: Right.
There's not a ton of case on it, but yeah, it's an open debate.
Derek: Yeah.
Interesting.
So he was going, let's say, you know, in this case, it says 115 text messages.
So it'd be 115 times anywhere from $500 to $1,500?
Joe: Right.
Derek: Okay.
So that's a lot of money just for him, and then he might even want to create what is
called a class action lawsuit so he'd bring other people that feel they've been wronged,
and then...So this could have been an extremely big case?
Joe: It could have been not.
Now, what you can do is sue for your own injuries.
What you can't do as a non-attorney is bring a putative class action, because there, you
need competent class counsel.
And so, since he doesn't have a JD, he couldn't do that.
Now, that's not to say that the other plaintiffs' attorneys who watch TCPA cases closely weren't
thinking, "Ah, what do we have here?
Let me jump in and PIP Ricky to the class action case."
Derek: Okay.
So somebody helps him out essentially once there's some meat on the bone, I guess.
Joe: Or the TCPA claimants attorney would just push Ricky out and kind of take over
and say, "I'm representing the class," and Ricky is just a class member.
So you could get blood in the water...
Derek: Because you don't need his permission essentially, because you can find your other
people?
Joe: Oh, yeah.
There are plenty of TCPA cases where, you know, it's plaintiff one, and then a couple
weeks later, a couple days later, plaintiff two.
And then the plaintiffs' attorneys fight over who's the right lead counsel.
So you get that blood in the water and sometimes you can get a little fight from the sharks.
Derek: So what happened in this case?
Joe: At the trial level, the Express Text, the defendant, very quickly moved for summary
judgment.
And summary judgment is the procedural vehicle where you go to the court and you say, "Look,
all of the undisputed material facts show that we win as a matter of law."
So let's break that down a little bit.
Undisputed, meaning neither side has a real beef about what actually happened.
And then material facts mean the fact has to matter to the outcome.
So if it was cloudy on the day he got the text, that's not material to a TCPA case,
but the weather might matter to a traffic accident, where it depended whether it was
reasonable for you to slow down when it was raining or whatever.
So the weather is not material in some cases and material in others.
So you got to show that everybody agrees on what the key facts are, and the judge decides
what's key.
And then, if everybody's in agreement about what the undisputed facts are, does one side
win or lose as a matter of law?
Which is to say, there's nothing left for the jury to do.
So we don't need a trial because the judge decides the law and the jury decides the facts.
But if there no facts up in the air, I don't need a jury.
So, judge, here are the facts, you just figure it out.
Derek: So this is pre-jury, pre...like, you know, a "Law and Order" type, you know, what
people usually kind of see two sides arguing.
This is, you know, "Hey the facts are the facts, so there should automatically be a
ruling.
We don't need all the other stuff."
Joe: Exactly.
And so, but, you know, for everybody watching the video, a month...filing a summary judgment
motion a month after answering the complaint is very early.
Typically, discovery takes anywhere from four to five months on the very aggressive end,
to years on the reasonable to far end.
So when Express Text moved for summary judgment early in the case, it was an aggressive move
to try to just put this case out of its misery early.
Derek: And he wanted to win it, right?
Oh, no.
Express Text was the one that filed this summary judgment, right?
Or they...
Joe: Correct.
Derek: Okay.
So they thought this was so ridiculous and that it had no, you know, merit essentially,
that they said to the court, "Let's just decide it right now, you know, based on all the facts."
And they were confident enough that all the facts were leaning towards them, I guess.
Joe: Correct, right.
So they put in a c-level affidavit explaining how the Express Text platform works, and how
it would have been its customer who chose who, you know, who to send the messages to,
when to send the messages, what the content was gonna be, a typical platform versus sender
setup.
And so, since they were the platform, they explained to the judge, you know, "Your honor,
we don't do the kinds of things that the TCPA attaches to sender liability, right?
We just provide the underlying technology that a sender uses just like you and I might
use to make a phone call," right?
It doesn't look like an iPhone, but from someone who wants to send commercial text messages,
this is how the platform works.
But it still requires a high level of involvement of the user to decide who gets the messages,
what they say, when they're sent, and so on and so forth.
And that, under the law, is the sender.
And in response, Mr. Franklin said, "Well, I don't know anything about your Express Text
relationship with WorldWin.
I don't know how your platform works.
I hear what you're saying, but I can't rebut any of this."
And so, there's a procedure in federal law that allows the plaintiff to say, "Hold on
now, this summary judgment motion is being filed too early.
You need to give me a chance to go depose these people, get the underlying documents,
and engage in the kind of discovery that I'd need to test, you know, those propositions
that you're putting into evidence."
And the trial court was having none of it.
They said that the facts are undisputed, which is unsurprising because Mr. Franklin didn't
really have a chance to test them, and gave summary judgment to Express Text.
And Mr. Franklin appealed to the Seventh Circuit Court of Appeals, which is the appeals court
that covers that Chicago Federal District Court.
And just by way of background, the Chicago Federal District Court has one of the highest
TCPA caseloads in the country.
So, they see these every day, they get filed there every day, it is clogging their dockets.
And you can sense from some of the judges at least a level of exasperation at these
kinds of cases.
Some of them have merit, but plenty of them don't.
And so, when...You know, when these combination of professional plaintiffs with, you know,
not a clear path to victory come forward, it's not surprising to see a trial judge say,
"Okay, I've got a lot of these.
Let's get the wheat separated from the chaff, and get rid of the bad ones."
And so, I'm sensitive to the trial court's ruling in this one, but Mr. Franklin appealed
to the Seventh Circuit, and they briefed the issues about the extent to which Mr. Franklin
should have been given more discovery, on the one hand, and whether he should get discovery
on all of those messages that came after Express Text manually opted him out of the campaign.
And so, that's the decision that came out earlier this month, in March of 2018.
Derek: And then what was that?
Was it that he doesn't have that right?
Joe: The Supreme Court...Oh, sorry.
The Seventh Circuit reversed and said that he did have that right, that the trial court
granted summary judgment to Express Text too soon, that it was unfair essentially to the
plaintiff to not be given a chance to get the contract between Express Text and WorldWin
to figure out how the platform really works in practice, and kind of get under the hood
and test the representations that were before the court in the form of that affidavit that
supported the summary judgment motion.
So they said that the trial court, you know, the trial court jumped the gun, and Mr. Franklin
should get that discovery.
And then, of course, Express Test, assuming everything they said is true, they'll just
refile the same motion and say, "Even after discovery, Mr. Franklin's unearthed no information
that would suggest that we are the sender of the messages."
So I would imagine that this is a road bump rather than, you know, a real change in the
outcome of the case, assuming of course that Express Text was honest in the declaration
and nothing new comes out.
The important thing for us, for the bystanders of this case, and the folks just that track
TCPA developments in the courts, is what the Seventh Circuit concluded about his messages
that follow the manual opt out.
They called foul on Mr. Franklin's attempt to gin up more messages by texting "Hi" and,
"What's the weather?"
"Is there a real person behind these, you know, these answers."
The Seventh Circuit was unequivocal that he gave express consent to get answers or automated
messages, when he knowingly sent textual narrative text to a platform that he knew to be associated
with an auto-dialing type platform, where he did anything but text "Stop," right?
Like Express Text and the brand did what it was supposed to do.
They told people, "If you wanna stop getting these messages, text 'Stop'."
Four letters, like a stop sign.
It's easy, everyone can do it, you know, just do that.
Don't play games and try to, you know, go left, go right, shuck and jive.
Derek: So it seems like the TCPA is being a little more kind of, I guess, brand and
software friendly nowadays or they're starting to see a lot of these types of cases where
they're manufactured cases.
And it's not holding as much weight as it used to maybe when it was more...TCPA was
newer to people.
Joe: Well, unfortunately, there have been bad partial revocations in phone call cases.
But on the SMS space, I'm seeing courts take a much harder line for opt outs and revocations,
where, I agree with you in that sentiment.
So, I wouldn't put it "TCPA writ large," but...
Derek: Just for SMS.
Joe: For SMS, because you have, you know, you have the text, like you see what everybody
said, right?
It's recorded.
Everybody has got a log of what happened.
So the courts have a very clear understanding of who said what to who, and they see that
narrative, you know, go back and forth and it's much easier to call balls and strikes
there and say, "Look, you have a very easy opt-out mechanism.
The fact that you chose to avoid it means that you were not trying to exercise reasonable
opt-out methods, and were really just trying to gin up your TCPA damages."
Derek: And you have the record, you know, of the text message.
And now, you said that was kind of just, you know, basic is something to look for in a
software provider to make sure the records are kept.
I've heard some kind of crazy stories where, you know, after a year, the records are destroyed.
You know, it is a good example of why keeping records, even hypothetically, let's say, you
leave an SMS platform, go to another platform, you need to get all the records from the original
platform, you know, of all the messages in and out before you leave the platform.
Joe: Right, right.
Because consent is an affirmative defense, so it's on the burden of the sender or, you
know, whomever's making those calls or texts to prove consent.
So you can't just put in a declaration that says, "Oh, Well, you know, don't worry court.
We really did have their consent to send those messages," because then you're definitely
going to...Not definitely, but in all likelihood you're going to trial on that issue, and that's
not where you wanna be.
You wanna show that the, you know, the undisputed evidence shows that you had consent and the
TCPA has a four-year statute of limitations.
So that's the minimum that you want to keep that kind of...You know, that kind of consent
record for.
We've definitely heard folks say, "Well, I don't want to keep my call records because
that's gonna show how many people I called or sent texts to."
Well, bundled in those call records is the consent, typically.
So you don't wanna throw the baby out with the bathwater.
So if you're conducting your campaigns properly, you have every incentive to just keep the
data that you have and show consent.
And it also helps, in a related vein, make it more difficult for the plaintiffs to get
class certification.
Because if you can show that consent is a key issue that separates potential class members,
you create these individualized mini-trials and the courts aren't going to grant class
certification when they see that consent is an overriding issue in the case.
So the more evidence of consent that you have, the better for your defense strategy.
Because losing class certification is a key inflection point in any TCPA case.
Because then the plaintiffs' lawyers are, you know, rubbing their fingers together,
seeing the yachts.
Yeah.
And they're just off to settlement.
Derek: And just to be clear, so the 115 text messages, this Ricky Franklin thought they
were...Let's just call them unsolicited.
He didn't opt-in for these text messages.
Maybe, in that, I don't even know if it was decided or not.
Joe: It was.
Derek: Oh, it was.
Okay.
So...
Joe: And it was not.
It was not.
Derek: Oh, it was not.
Okay.
So let's hypothetically say that, you know, 115 text messages, these were unwanted.
Because I think what it brings up is a more interesting point is Express Text got themselves
out of a lawsuit.
Now, if these were solicited, unsolicited, whatever, it really doesn't matter because
Express Text, what they were telling the court was, "We don't belong in this lawsuit, in
this TCPA lawsuit, because we are not the sender."
Joe: Correct.
And that's the key verb, right?
You have to initiate or make or send the message.
Now, vicarious liability can stretch out who is the sender.
But the case law is pretty clear that if you don't control the questions of whether to
send the message, when to send the message, who gets the message, you know, in courts
and even the FCC waffle a little bit about the role someone can have in crafting the
content of the message.
But if you're not answering the "whether," the "when," and the "to whom" questions, you're,
in almost all cases, not the sender of the message.
And so that's what the TCPA really covers is, I am putting liability where it should
be, which is who chose to send that message.
Derek: And in this case, or most cases, when you're using a software provider, if you're
a brand like Kohl's or WorldWin, Car Pros, whatever it is, it's usually, you know, the
brand is going into the software provider.
They're logging in, they're selecting which, you know, subscribers or people that didn't
subscribe, whatever it is, you know, hopefully not, you know, to message.
They're creating the message.
They're clicking "Send," and the software provider, essentially, just sits there being
a software provider.
Joe: Right.
The analogy is if I start spamming people via email, you don't sue Microsoft just because
I'm using Outlook, right?
Like, I chose who to send the messages to.
Derek: It's your fault.
Joe: Yeah.
It's on me.
So that analogy is good so far as it goes.
And carriers, and fax broadcasters have explicit FCC exemptions such that if they exercise
no active control in the recipient list or the content of the message, they're exempt
under FCC rules from liability.
Derek: And that's why we don't see like, you know, instead of Ricky R. Franklin vs. AT&T,
if the message came through AT&T to his phone, you know, because they are a what, a common
carrier?
Joe: Yeah.
That's not the...They are a common carrier, but that's not the basis for their liability.
Derek: Because they're not sending the message, just like Express Text is not clicking "Send".
Joe: Right.
And so, early, after the passage of the TCPA, the carriers got together and said, you know,
"This is not on us.
We're a dumb pipe, you know, don't even drag us into these cases."
And so, the FCC, early in the TCPA's life, created this explicit exemption for carriers
because they didn't wanna get drug into lawsuits.
Now, back in the '90s, after the TCPA was passed, there was just a small smattering
of lawsuits.
It's nothing like the 4,000 to 5,000 cases a year volume of cases that we see today.
But in any event, the carriers got an explicit FCC exemption that contains those caveats,
like, you know, if AT&T and Verizon are collecting for their own bills that are unpaid, and they...
Derek: Yeah.
And they're clicking "Send".
Joe: ...and they're clicking "Send," then sure, they are the sender, right?
Derek: Okay.
Joe: But if you're acting as the proverbial dumb pipe, they're off the hook.
Derek: And that's what software providers right now, if they are brought into these
lawsuits, they are essentially saying that, "We are a dumb pipe, you know, and that this
is not, you know, our problem essentially."
Joe: Right.
And a number of platform providers, SMS platform providers, went to the FCC and said, "Hey,
FCC, you've given common carriers an exemption.
Later you gave so-called fax broadcasters the same exemption where, same deal.
If you're not choosing who gets the fax, what the fax says, when it goes out, etc., you're
off the hook.
You're just the broadcaster, and you're not liable."
The FCC granted that one.
So everybody thought that, you know, we'll just continue that pattern and the SMS industry
would get that same exemption.
For whatever reason, the FCC chose to do a kind of totality of the circumstances test
and rejected that petition to get that same exemption for SMS broadcasters and left it
to the courts to look at that totality of the circumstances.
But the courts have essentially crafted the same test, you just have to go through it
time after time to show that you really didn't for that client engage in those things that
would tip you over from broadcaster or sender, if you will, platform provider, over into
essentially functioning like the arm...the marketing arm of that brand.
Derek: Okay.
So this brings up, I think, two good points for text message marketers, just from my mind.
One is, let's say, like a marketing agency.
So let's say, a marketing agency, we'll just use Express Text in this example, is using
Express Text, it's hard to say.
And let's say, they represent, you know, what is it, WorldWin Events.
If the marketing agency is using the software provider, but they're crafting the messages,
they're coming up with the time to send it, but the brand is the one, you know, that is
in the message, but the agency is the one doing all the work, that might be a liability
for the agency.
They need to be just as cautious as the brand, or WorldWin.
Joe: Absolutely.
Right.
So if you're stepping in the shoes, and essentially acting for the benefit of the brand who's
hiring you to, you know, to serve in that marketing, you know, marketing campaign development
capacity, there can be exposure there under what lawyers call vicarious liability.
You know, the most lay example you can think of is when the UPS truck driver hits you,
you can sue both the truck driver and UPS, because the truck driver was obviously working
for UPS at the time, and they were acting as their agent, and UPS was the principal.
And under centuries-old common law, you can hold the so-called principal, UPS, liable
for the acts of the agent, the driver.
Derek: Everybody.
Joe: So there, so in this case, the marketing agency is like the driver, and the brand is
the UPS.
Derek: So for like a marketing agency, number one, when they're doing text message marketing
for a client, they need to be educated, you know, on TCPA compliance.
They need to be compliant.
And I always recommend going to a third party, you know, counsel to, you know, get that kind
of advice.
And then, on the other side is the brand, when they're hiring a marketing agency, they
should be checking the marketing agency to make sure they know, you know, TCPA compliance,
because, you know, they could get them in trouble as well.
Joe: Right.
Because what happens there, whenever you have a dispute between the brand on the one hand,
and the agency on the other, that's a side fight between the two of them.
The brand always says, "Oh, the agency agreed to defend and indemnify me."
And that's only as good as their resources to put behind the fight.
These TCPA cases can get expensive fast.
So if the agency is a small shop, and they don't have the insurance to back it up or
the financial resources, if there's no insurance available, to defend and indemnify the brand,
you're still on the hook because the plaintiff doesn't care what the side agreement was between
you about who's going to absorb any risks and liabilities associated with a campaign
gone wrong.
So both of those companies is most likely going to be defendants in the case.
And so it's...go ahead.
Derek: Okay.
And then...Oh, yeah.
I was gonna say the other component is, if all these software providers, well, software
providers are great, you know, we're a software provider.
It seems like in these cases, the TCPA cases, they're essentially always, or most of the
time, able to remove themselves from the case.
And saying, essentially saying, "Not my problem, it's the brand's or the agency," whoever's
clicking "Send," it's their problem.
So...Yeah.
Joe: Right.
Because it's like...I do think that the courts have settled on that test of where the platform
provider can stay in the safe zone, and not wear the sender hat, and where you start to
blur the lines, when you start to get involved in the clients' particular marketing campaigns.
And so, as long as the platform providers are, you know, acting as the dumb platform,
as it were, the dumb pipe, and just providing that, you know, brand facing functionality
to be able to manage and conduct their campaigns, and provide the interop between the brand
on the one hand and the wireless ecosystem on the other, you're fine.
You know, you're...
Derek: And I guess my point to that is, you know, always watch out who's giving you their
opinions.
Because I hear a lot of brands and marketing agencies, they'll go, "No, it's okay.
My text message marketing software provider told me it's okay."
Joe: Okay.
Derek: Now, the problem I think with that is that's great if the software provider is
also on the hook.
And if they, you know, don't have kind of this exemption, essentially that the courts
have kind of said that they have, so it does bring up another point.
If you're a brand or marketing agency, software providers can give you great advice, but I
would also get a third party's advice, which is like a TCPA attorney like you are.
Because, at the end of the day, you know, the Express Text or whoever it is a software
provider, essentially, they can remove themselves from the liability.
Joe: Right.
And I mean, there's two things going on there.
There's the moral hazard of the platform provider wanting to generate more business, right?
It's understandable, but there's a bit of a conflict there.
To the extent that their revenues are increased by their brands and their consumers sending
more messages, well, maybe you don't feel terribly comfortable about taking their advice.
And then there's the related issue of, do they really track the case law every day?
Right?
They might hear these things anecdotally at a conference or, you know, their lawyer told
them this three years ago.
Well, as we know, just last week, the DC Circuit issued, you know, a monumental decision, or
two weeks ago now, and, you know, in the TCPA context.
And you've got to stay up to speed on these things.
And, you know, it's not just appellate level decisions.
The case law varies, you know, somewhat dramatically based on where in the country you are.
So depending on, you know, whether you have a national footprint or if you have a heavy
consumer base, in the southeast for example, where the Eleventh Circuit has some fairly
TCPA plaintiff-friendly decisions as compared to other courts, like the Second Circuit that's
been much more business-friendly, you know, you just wanna be sensitive to these things.
And I don't know that a platform provider has the time or wherewithal to be focused
on these things on a regular basis.
Derek: Yeah.
They're a platform provider because they spend all their time building a platform, not tracking
TCPA law.
And I've talked to David, your partner, on this a lot.
And these videos are not supposed to replace legal advice.
I think they're more just to get people thinking about things, and asking the right questions
of their TCPA attorneys.
Joe: Absolutely.
Yeah, no, I mean, we put a ton of free content on our website because it's not a substitute
for nuanced, up-to-date analysis and advice that we couldn't possibly give here in this
kind of setting.
Because so often, the facts are critical in deciding which way you go and you wanna, you
know, you wanna talk to your client about what their risk tolerance is, and where they're
willing to go and...So, yeah.

Joe: Well, I mean, I do think it's a good reminder to make sure that you're complying
with the CTA guidelines as it relates to including "Stop" as often as you need to in your campaigns
and making sure that you're selecting a platform provider like Tatango that takes those expectations
seriously.
Because, you know, I don't know that the outcome would have been the same if Express Text wasn't
including Stop instructions in those messages.
So...Right?
You wanna make sure that your platform provider's at least sensitive to those issues, because
the outcome could well have been different, had the court didn't have the record in front
of it to say, "Well, you were given clear instructions every time to text 'Stop' to
opt out, and when you didn't, everyone's going to assume that you were purposefully evading
a reasonable opt-out mechanism."

Joe: Yeah, yeah.
Derek: [inaudible 00:33:24]

Derek: ...you just don't understand how to opt out.
If you reply back, "Is this a real person answering these text messages," and then it
sends back a message saying, "Thanks.
We got your response," that's not really helpful to the consumer.
And they're gonna get frustrated, and as you get frustrated, that's when you go to an attorney
maybe you become a plaintiff, or a professional one.
So, I think it's a good lesson for SMS providers and the brands.
Make sure your software provider, no matter what you're texting in, and how you're interacting
with the system, there's always those instructions in there.
Because a frustrated consumer is just something no one wants to deal with.
Joe: Exactly.
Right, professional plaintiff or not, you want everyone to have a good experience, right?
The professional plaintiff is never gonna have a good experience, unless they have a
successful case.
We can't really guard against every one of those, but from, you know, a brand management
perspective, you wanna make sure that everybody's getting the level of, you know, detail and
attention that you'd expect.
Derek: Awesome.

EVERGOODS MPL30 Review (Mountain Panel Loader) | Crossover Backpack in the Travel Context - Duration: 14:24.
- In this video,
we're gonna be reviewing the
EVERGOODS Mountain Panel Loader 30.
This isn't necessarily a travel backpack but,
when two guys come together from Patagonia and GORUCK,
it definitely catches our attention.
We're curious to check it out.
I'm Tom the founder of Pack Hacker
and we do travel gear reviews like this all the time.

Without further ado,
let's jump right into the MPL30 from EVERGOODS.

Hopefully you like black because
the MPL30 only comes in that color.
For us personally, that's plenty,
but you're not gonna get a lot of
other color variety options like you
would see in other packs.
The exterior of this pack is covered
with a 420D high tenacity nylon
with the one by one plain weave
and polyurethane coating on the back,
which is a technical way of saying
that the pack is durable, abrasion resistant,
and worth the wait.
There are a couple other areas that
are made out of 500D nylon as well.
We've generally found this fabric
to be very durable in our testing,
although it's not completely dust proof.
But again, it's black.
Not a lot of packs are.
The overall shape of this pack is very ergonomic
between the curve straps in the front
and the curve frame sheet and the
shape of it in the back as well as
the kind of wedge look on the bottom.
It has an overall kind of aggressive look to it and
definitely fits your body well.
It's super comfortable and looks slick.
It's also highly compressible.
On days when you're not carrying as much,
say you take out a bunch of packing cubes,
leave them at your hotel or AirB&B,
you can actually compress the pack down
and it has a lot lower of a profile
that if it's completely full.
That's definitely a plus in the aesthetic department.
The pack uses Duraflex plastic throughout
on these compression straps as well as the buckles.
Also, nicely there's the EVERGOODS
logo underneath this two by two inch patch area
that we have on the front of the pack.
This is a reflector patch that they've included but again,
anything with velcro will work here.
EVERGOODS is super into the details
and they do a great job at openly
sharing this for people that wanna get this information.
They sent us a three page very detailed
PDF on all the materials and we
were super excited to look into that.
EVERGOODS definitely put a lot of
thought into the details of the MPL30 and it really shows.
Starting off with the compression straps.
EVERGOODS put a lot of good detail into these.
First of all, it's attached behind the main panel
opening of the backpack.
You don't have to clip it, un-clip anything
as you're getting in and out of the pack.
Really great feature and it kind of
compresses it right before that zipper.
Another thing that they have are
these elastic keepers on the side.
If you do have excess strap going on,
it's pretty easy to just quick roll it up.
You just put it over and boom,
you don't have a bunch of excess strap laying around.
We also notice that this feature
exists on the Patagonia arbor pack
so it's definitely cool to see the
inspiration from Patagonia and GORUCK
and kind of how those two came together.
You can really tell with this pack
how they've been influenced by each of those brands.
These sturdy strap panels on the sides
here offer a pretty good carry for short distances.
They offer a decent amount of padding and firmness,
but not too much where it feels squishy.
Again, those are gonna be good
for just quick carries whenever you need it.
Saving the best for last,
the harness system on this thing is absolutely killer.
I mentioned before that the pack
has kind of more of an aggressive look.
Well, this frame sheet is slightly curved
that contours to your back so it
fits really nicely and kind of just hugs you.
When you initially put this thing on,
it does feel like it's kind of giving you a hug.
These pockets on the sides where the waist belt is
kind of conform around your hips.
Then the straps as well kind of curve
over the front of your body.
Definitely feels great and for me personally,
at six foot two around 180 to 190lbs, it works well for me.
It fits me super well.
Now, it wouldn't be a Pack Hacker review
without a couple of gripes.
We're gonna get into those now.
Little nit picky details that we noticed.
Starting off, the sternum strap isn't entirely attached.
It is adjustable which is good but,
it's not fully secured though so there's
a very slight, slight chance it
could pull out without you knowing it.
There's no way of really fastening it to the side.
Although it's really great that it's adjustable.
Also with the waist strap,
there's really no way to store these.
I've seen a couple people stuff
these into the side pockets here.
Not necessarily what they're intended to do
but it'll work in a pinch.
That specifically from EVERGOODS
is kind of part of the design.
They wanted to create a trail pack
and they kind of went all the way and did it all the way.
Another thing is with the shape of this pack,
you can't necessarily stand it up straight
because the bottom is angled and EVERGOODS, again,
intentionally did that.
They shaped it in this way so that
more weight would be distributed to your hips.
When you're on the trail or whatever
it ends up being a lot more of a comfortable carry.
This can get annoying in the coffee shop
if you wanna have it sitting up
next to you with your stuff in it.
You're gonna have to have it lay flat but again,
EVERGOODS went aggressively in one direction with this pack.
One other thing with the harness is that
the wing tips aren't necessarily good for everybody.
If you have a wider set or you have a smaller frame,
there is a chance that they could
kind of poke you in the back rather
than contour to your body.
Definitely just keep that in mind.
I've personally found this system to be great.
I like that the pockets are back here.
You could quickly access them and
you kind of can feel around in there and grab what you need
and I do love the overall harness system of this pack.
Big fan of it.
There's a bit of a hole on the top of the harness here
and what that's for is that you
can thread a hose from a water bladder
right through the strap system
so you can access it whenever you need it.
The back panel of this is great.
It conforms to your body and has
a bit of a chevron pattern going on here
which is reminiscent of a turtle shell.
Due to the shape of this pack,
we don't necessarily need low lifters on it.
If you have a more square travel backpack
with a flatter back panel,
you're gonna wanna get low lifters on that
so you can pull that weight closer
to the top of your body and to your back but,
in the case of the EVERGOODS MPL30
and the way it's been designed,
kind of ergonomically curves to your back and fits you.
You don't necessarily need low lifters
or something like that as the weight
is already evenly distributed with this pack.
Moving onto the last exterior feature of the pack
we have these grabbers here on the main panel of the bag
so it's easy to just grab those,
quickly rip open the pack.
Boom, you can get in and get out and get whatever you need.
One thing that I did find that's
good with these too is it creates a slight security feature.
It's definitely a hack.
It's not really what it's intended to do but,
you can weave the zipper pulls through here
and create a little bit of a more
challenging way to open your pack.
You could even tie it around that
loop or something like that.
Isn't necessarily fool-proof but
for somebody quickly coming by
and just wanting to open that main compartment
and get to your stuff quickly,
it's gonna deter them a little bit more.
It's definitely good in that aspect.
There are two exterior pockets in this pack.
The one on the top here is good.
It just opens up.
It's kind of a nice compartment.
You can fit quick-grabs, anything,
whatever you need to put inside of here.
It sort of just opens flat and it's a nice way to access it.
Move onto the other pocket.
This here, you can access from the side.
What the intention is here is that
you're wearing the MPL30, you flip your bag around
and you have it in front of you,
and then you can access that pocket.
One of the gripes to that for here is that
a lot of people wish that it was
on the other side of the pocket.
For this one, you kind of have to,
let me just put it on real quick.
When you put it on here and then you flip it around,
and then you can get into that pocket here.
You can grab whatever you need out of here
which is pretty good.
Some people say that they would
prefer to be wearing the pack like this
and then they would wanna whip it around
their right hand side 'cause if
this is your dominant hand, if you're a righty,
that feels a little bit more natural.
Open it up with the left hand and then
be able to dig around inside of there but,
the zipper is at the bottom.
It isn't necessarily designed for a righty or a lefty.
You could definitely get used to whatever
mechanism it has but again, if we're being nit picky,
that's something that I've definitely
seen a lot on the internet.
It doesn't really bother me personally
or any of the contributors that were taking a look at it.
It's something we noticed.
A really great thing about these two pockets here
is that they are leader independent of the pack.
What that means is if you load up
that main compartment of the pack,
which we're gonna get to in a second,
just hold on, hold your horses,
it doesn't cut into how much room
that you have in the entirety of the pack.
Kind of works well as three compartments
that sort of independently compress themselves.
As you're putting more and more gear in here,
each compartment kind of compresses itself
and doesn't eat into the leader capacity
of the other compartments.
Both of these pockets here have the
YKK number eight zippers.
They're really high quality zippers.
Of course we got the number 10 racket coil zipper,
an industry standard for quality on this part.
One of the great things about this main clamshell
is you can almost use it as a top loader as well.
The way that the zipper is shaped,
you can really just kind of fold down that front
and get access to the view of the
inside of the entirety of the pack.
That's really nice if you just
want to quick see what's going on inside.
Of course it also fully unzips as well
down to a main panel here.
There's a decent amount of room inside of here.
Again, if you have packing cubes,
that's gonna be the way to go here.
Just allow you to organize your stuff a little bit better.
There's not a ton of additional
organization inside of this main panel,
which is totally fine for us.
We're packing cubes people.
Just a note, the lining here is green
and all the zipper pulls are green
to make it a little bit easier
to see your black gear when it's inside of the pack,
not to be confused with the black
zipper pulls and the black material on the outside.
It's important to note that the
liner on the inside is the same
exact material, just a different color.
It's that 420D high tenacity nylon.
We got the stash pocket at the top
which perfectly fits a passport, even within the case.
Inside of it here we've also got a
clip for keys, anything that you might wanna put in there.
That's definitely good.
Let me move onto this mesh pocket here.
It's a bit of a funky shape.
It's sort of got this wedge trapezoid
kind of shape going on.
We found that to be kind of interesting.
Of course with the shape of this pack and the ergonomics,
a lot of this stuff isn't gonna be an exact rectangle,
but just note that when you're packing it.
You could fit a little bit more at the top
in this mesh pocket then you could towards the bottom.
There's also some nice detailing here
with the EVERGOODS information,
which is just nice to have.
They definitely do a good job at branding
and it's also subtle.
There's not a huge logo on the outside.
If we take out all of the packing cubes,
we can give you a good look of the clamshell inside of this
thing and the main compartment.
There's a bit of a loop here,
which is gonna be good for a water bladder or hose.
Again, you could kind of put your water bladder here,
you thread that hose through this hook on the top,
and then you pull it through one
of these two sides that we got going on here
so you can thread that hose through
towards the front of the strap
so you can have it hanging next to you at all times.
There's a bit of velcro here and
what that is is it's for the frame sheet.
Don't use that as a pocket.
Lastly at the bottom here we have
an elastic part that again is gonna
be good for the water bladder or it can hold-.
We tested a MacBook Pro to 15 inches,
the older model as well as the new retina model.
It'll fit that nicely and there's
some corner holes here where the sides can poke out of.
That's just a nice additional feature
to have with this pack.
At the time of this review,
we've been testing the MPL30 for
a couple solid months across trips
from New York City to Detroit, California and Minneapolis.
During those trips and almost daily use during them,
we could say that the pack has overall held up
and we have no complaints on the durability at all.
The only thing that we will say is
that it just ended up picking up some dust
and that's about it.
Again from a travel perspective,
it's more designed for a trail
than it's designed for one bag travel
so just keep this in mind.
You're definitely gonna be able
to fit more into a more square shaped backpack,
although you can fit a surprising
amount in this and it feels really good to carry.
To wrap this up with some pros and cons,
there is a lot of well thought out,
ergonomic, comfortable design going on with the pack.
There's some great thinking around the user experience
with the strap keepers, the compression straps,
and the overall curved and ergonomic shape of the pack.
Also, EVERGOODS use excellent materials
and build quality is high.
For some of the cons,
the hip belt is not hideable other
than stuffing it into the wing pockets which is not ideal.
The sternum strap isn't fully attached.
It also doesn't fit well on every body type but again,
when it fits it works super well.
Although not necessarily categorized as a travel pack,
the MPL30 has been a super slick companion and a joy to use.
The pros greatly outweigh the cons
and we can't wait to see what they come up with next.
Hopefully they'll do something with a travel bag soon.

Google Changed Its Review Policies & This Is What You Need to Know - Duration: 1:33.
Hi, I'm Zac Herr, and I manage Renown, the review marketing platform here
at RevLocal. And, this is your Digital Marketing Refresh.
You may have heard that Google recently changed their policy
stating that you can no longer discourage or prohibit negative reviews,
or selectively solicit positive reviews.
Here's how that'll impact you as a business owner.
If you currently use a review marketing service to solicit reviews from your customers,
you can no longer first ask them if they had a positive
or negative experience with your business
in an effort to filter out negative feedback.
This is commonly called a sentiment check.
If you continue this practice, Google may penalize you by removing the
reviews you have on your Google My Business listing.
While this may sound scary and nobody wants to lose their reviews,
this really isn't the end of the world.
It just means that now more than ever, it's extremely important
to have a person monitoring your reviews rather than automated technology.

without violating Google's policies.
