BREAKING: After 10 Years The Truth About Barack Obama Goes Finally Public(VIDEO)!!! - Duration: 13:14.BREAKING: After 10 Years The Truth About Barack Obama Goes Finally Public
damaging new text messages surfacing from FBI officials Peter struck and Lisa
page they suggest possible coordination between the Obama White House the CIA
and FBI early in the Trump Russia probe names that appear include White House
chief of staff Denis McDonough CIA chief John Brennan FBI director James Comey
and Senator Harry Reid page and struck apparently attempting to cover their
tracks this text three months before the presidential election make sure you can
lawfully protect what you sign just thinking about Congress FOIA etc you
probably know better than me Andrew McCabe the top FBI official fired by the
Attorney General Jeff Sessions hours before his planned retirement is now
soliciting donations online for his legal-defense fund no word yet on
whether Clinton donors which supported McCain's wife during a run for Virginia
senators state Senate have pitched in as yet well joining me now Chris Farrell
director of investigations and research for Judicial Watch Chris Farrell
welcome to the show again good sir explain to me how the struck page
messages going backwards and forwards brings a present Obama the Obama name
into play go through it for me sure there's clear evidence in their own
language their own text messages explaining how they were communicating
coordinating with White House officials for example there's a there's a Lisa
page text message that we uncovered a few weeks back that says quote POTUS
wants to know everything we're doing that is pretty clear language by anyone
standard we also know that Andy McCabe had meetings on his calendar with Lisa
Monaco who is the Obama White House White House Homeland Security Director
and guess who she used to work for mr. Muller so this is all very cozy and it's
very apparent now with the addition of Brennan who's at least in his last few
hotel television appearances seems somewhat and unhinged
that the there was direct White House involvement in this if not coordination
this is the kind of stuff that would make Richard Nixon blush this is deadly
serious stuff and I'm glad that you're covered it but it should be you know a
ten minute segment I'm not a reader if they had at the head of the news please
forgive me for breaking into this particular segment on this subject but
please go back to John Brennan sure what he said about the present I saw that I
heard it that blew me away I'm astonished that a former director of the
CIA would say that about a sitting president yeah I mean he may be a
political opponent that have all sorts of personal opinions but the man has no
integrity and no dignity he has no business as a former CIA director
sitting there and sort of you know free associating and speculating about what
he thinks might be it's a it's a disservice to the country it's a
disservice to the office of the presidency this guy is humiliating
himself he's turning himself into a cartoon character by making reckless
comments that really denigrate the office and really undermine the public's
faith not just in the presidency in the government generally but in who picked
this guy to be CIA director and this is really reckless conduct now we have the
Utah prosecutor mr. Huber and we have Michael Horowitz I believe they are both
Obama holdovers they are and they are going to be investigating the Obama
administration this is what makes it work in public crazy this is the kind of
nonsense so they try to blow a fast ball past the American public and we're
supposed to just stand there and say oh okay you're doing something I've told on
the show earlier look the inspector general's office is where the truth goes
to die and now you've got an outsider Obama appointee from Utah he may be a
wonderful man I'm not I'm not attacking him personally but he doesn't
necessarily have the biggest heavy-hitter resume in the world and
he's supposed to come in and he's gonna clean up what's been going on and let's
circle back to your opening comment about the level of involvement from the
Obama lighthouse Inn in staging this attack on
the the incoming president this makes Judicial Watch supporters
crazy it makes Lou Dobbs tonight viewers crazy
anybody who's paying attention they're throwing something at the television
right now you see so little of it now Lou is really the point man on this I
mean he's got more out there than anybody else and I'm just trying to
follow in his footsteps here but well I'm really astonished that so little of
this appears not just in the mainstream media but anywhere else
I make speaking engagements around the country I talked to folks who consider
themselves very you know politically aware and motivated whether it's
business leaders civic leaders and others and I lay out the story I just
did for you in greater detail and they're astonished yeah people don't
know that opening line about the White House coordination with this whole Comey
Strock page mccabe it's a conspiracy literally exactly exactly I didn't mean
to interrupt you there but you're right when you use the word conspiracy I'm
nodding my head because sir you are right it is Chris Farrell we do
appreciate you being with us tonight and always thank you thank you sir
yes sir FBI director Christopher Ray the Republican chairman of the Senate
Judiciary Committee Chuck Grassley says tax from October 2016 suggests then FBI
director James Comey chief of staff Jim ryebeck II believe deputy director
Andrew McCabe should recuse himself from the Clinton email case McCain's wife got
more than seven hundred thousand dollars from Democrats including longtime
Clinton ally Terry McAuliffe for a state Senate race FBI lawyer Lisa page writes
right Vicki just called to check in he very much 100 percent believe that Andy
should be recused because of the perception agent Peter struck replies
God later struck rights I assume McAuliffe picked up but that doesn't
make sense he said he was interviewing maybe he's headed into private practice
McKay did not recuse himself until one week before the presidential election
the new concerns about the bureau's impartiality come on the same day new
texts are firmed binding to the senior senators
with oversight the Justice Department Inspector General Michael Horowitz who
first discovered the anti-trump text between demoted FBI agent Peter struck
and reassigned FBI lawyer Lisa Paige said a forensic review recovered records
between December 2016 and May the letter did not fully explain why senators were
told in August the Inspector General had everything only to learn last week that
thousands of records were missing before traveling to Switzerland during an
impromptu discussion with reporters the president tested some media for avoiding
the story as the texts were apparently found the political rhetoric over the
four page memo documenting alleged government surveillance abuse took a new
turn with the house intelligence committees Republican chairman whose
staff drafted the memo traveling overseas the ranking Democrat drafted
his own version and took a swipe at the media who are covering the allegations a
former FBI agent elected to the House as a Republican
said the Democrats national security concerns are overblown I've read the
memo along with several of my colleagues and my estimation having had exposure
and experience with both FISA and title three wiretap that there are no law
enforcement sensitive sources or methods that we would be compromised here in a
letter the Justice Department expressed its own reservations calling any release
of the memo unprecedented and reckless the FBI and Justice Department want a
review before it goes public let us see it first at this point nobody in the
Senate or the White House or the Department of Justice or FBI has seen
this document though the Senators can't read the document the Minority Leader
weighed in today it's this memo on and on and on conspiracy theories with
virtually no fact some Republicans were pressed on the wisdom of releasing the
memo when the public begins to question the integrity of
the Department and the FBI and and conclude in the absence of other
information that somehow politics has taken over rather than the law that's a
very serious matter and we need to get that cleared up one one means or another
House Intelligence Committee would not comment on reports the memo identifies
McCabe Deputy Attorney General Rod Rosenstein and Comey Brett Catherine on
Tuesday Republican Senator Ron Johnson made a comment on this show that raised
a lot of eyebrows to me and then the reaction to it and today somewhat
sounded like he changed his tune we have an informant that's talking about a
group they were holding secret meetings off-site there's there's so much smoke
here there's so much suspicion let's stop there a secret society the secret
meetings off side of the Justice Department correct and you have an
informant saying that yes this text message seems to be the comment about
secret society was in jest do you agree that it appears to be it was in jest
it's real possibility saying it's a possibility Kevin what are you hearing
about the dust-up over those two words secret society
well we've confirmed the text message was sent one day after the election and
page rights to struck quote are you even going to give out your calendar seems
kind of depressing maybe it should just be the first meeting of the secret
society Fox News is told this is the only reference in the 384 pages of FBI
texts provided to Congress last week but for some context three weeks later in
December 2016 the five month gap of missing text begins and no one on the
hill knows what they show and whether they back up senator Johnson's
whistleblower who claims senior FBI officials held these off-site meetings
so we'll see when those newly recovered text messages are provided to Congress
according to this letter from the Republican chairman of the Senate
Judiciary Committee Senator Chuck Grassley the text messages released to
Congress last week raised serious questions about the impartiality of
senior FBI leadership during the Clinton email case and whether there was an
effort to dial back the investigation text messages from February 2016 at the
height of the FBI's criminal probe show agent Peter struck an FBI lawyer Lisa
Paige we're worried about the impact their careers and future investment if
they were too aggressive investigating Clinton's use of an unsecured personal
server exclusively for government business and the mishandling of
classified information page rights to struck one more thing she might be our
next president the last thing you need us going in there loaded for bear you
think she's going to remember or care that it was more DOJ than FBI struck
responds agreed I called the bill that struck spas bill pre-snap
and relayed what we discussed he agrees I will email you and redacted same on
Fox this morning another Republican member of the House government oversight
committee went further emphasizing the same FBI crew from the Clinton email
case then oversaw the Russia probe now we know the fix was in and of course I
think the logical thing is if the fix was in on the Clinton investigation and
then these same people top people to FBI started and ran the Trump Russia
investigation might there be some bad things going on there as well and as you
look at these text messages it sure looks like there is just want to offer
some important context here Struck's boss according to former FBI director
James Comey was the one in the bureau who decided to keep senior congressional
leadership in the dark about the existence of the Russia probe and it was
he who ordered not to brief the gang of eight at that time Sandra Catherine what
has been the response to the New York Times story that broke last night well
at the economic forum the President himself responded to the time since said
the allegations he ordered the firing of special counsel robert muller were
incorrect
because New York Times fake stories Fox's reporting has found there was a
meeting with white House Counsel John began and others where President Trump
talked about the idea of firing Muller and asked McGann if he would talk to the
Deputy Attorney General about that issue the source said McGann told the
president really in no uncertain terms that firing Muller would be disastrous
McGann was not ordered to fire a Muller then threatened to quit as reported by
the time Sandra all right Catherine Herridge thank you for your reporting
alikum thank you god bless you and God bless america

Mueller's Investigation Just Went Up In Flames – Stunning Connection To Hillary Clinton Goes Public - Duration: 12:11.Mueller's Investigation Just Went Up In Flames – Stunning Connection To Hillary
Clinton Goes Public
In the course of recent days, it's been affirmed that White House Special Counsel
Robert Mueller picked a staff brimming with Democrat agents to research President Donald
Trump's assumed arrangement with Russia in a year ago's race.
Presently, yet another colleague been connected to intense Democrats.
Flexibility Daily announced that it was recently uncovered that Mueller specialist Jeannie
Rhee has to a great degree close ties with the Clintons and the Democrat Party.
She worked for Barack Obama's Attorney General Eric Holder for a long time and has given
over $16,000 to Democrats since 2008.
She additionally spoke to Hillary Clinton amid her scandalous email claim in 2015, as
she attempted to square access to Clinton's private messages and her restroom servers.
Rhee was so near Clinton that she maximized gifts to her in 2015 and 2016.
Over that, Rhee spoke to the Clinton Foundation in the racketeering claim in 2015.
"Rhee joined Mueller's group in June, as per The Washington Post, and furthermore
filled in as an accomplice at WilmerHale," CBS News revealed.
"She had beforehand filled in as agent partner lawyer general in the Justice Department's
Office of Legal Counsel, where she prompted White House authorities and the lawyer general
on issues including criminal strategy and national security, as per a WilmerHale official
statement from 2011.
She likewise filled in as Assistant U.S. lawyer in the U.S. Lawyer's office for the District
of Columbia."
This comes after it was uncovered that one of Mueller's lawyers gone to Hillary Clinton's
race night party in New York City.
The Daily Caller announced that Andrew Weissmann's participation at the gathering is only the
most recent sign indicating the predisposition against Trump that this examination has.
Weissmann has been alluded to by The New York Times as Mueller's "lieutenant" and
"pit bull."
On Tuesday, moderate guard dog bunch Judicial Watch got a January email in which Weissmann
adulated previous Acting Attorney General Sally Yates' insubordination of Trump.
Legal Watch Reported:
"I am so pleased.
Furthermore, in wonder.
Much obliged to you to such an extent.
All my most profound regards," Weissmann wrote to Yates on January 30, instantly after
she trained the DOJ not to protect an official request prohibiting migration from seven countries,
a demonstration that prompted her expulsion by President Trump.
WEISSMANN IS JUST ONE OF MANY DEMOCRATIC DONORS THAT HAVE BEEN HIRED BY MUELLER.
THE LAWYER DONATED A COMBINED $6,600 TO THE PRESIDENTIAL CAMPAIGNS OF BARACK OBAMA AND
HILLARY CLINTON.
It was likewise uncovered for the current week that previous Mueller examiner Peter
Strzok, a FBI specialist, was dropped from the test after it was uncovered that he had
a solid hostile to Trump predisposition.
While partaking in the examination, Strzok traded various hostile to Trump messages with
his fancy woman Lisa Page, who likewise had some contribution
in the test.

BREAKING : After a Decade, the Truth About Barack Obama Goes Public! - Duration: 2:52.After a Decade, the Truth About Barack Obama Goes Public!
Barack Obama is undoubtedly in full panic mode right now after new documents came out
that expose how he colluded with the FBI and CIA to take Donald Trump down.
Fox News reported that newly released text messages between FBI officials Peter Strzok
and Lisa Page indicate that there was a coordination between high-ranking officials at the Obama
White House, CIA, FBI, Justice Department and former Senate Democratic leadership in
the early phases of the investigation into alleged collusion between the Trump campaign
and Russia.
GOP congressional investigators say that this new information "strongly" suggests collusion
between former President Barack Obama's Chief of Staff Denis McDonough, then-Senate
Democratic Leader Harry Reid, and CIA Director John Brennan.
The investigators added that this directly contradicts Obama administration's public
stance about its hand in the process.
On August 2, 2016, Strzok texted Page, "Make sure you can lawfully protect what you sign.
Just thinking about congress, foia, etc.
You probably know better than me."
The next day, Strzok wrote another text to Page talking about how former FBI Deputy Director
Andrew McCabe was concerned with "information control" related to the initial investigation
into the Trump campaign.
Days later, Strzok again texted Page, "Internal joint cyber cd intel piece for D, scenesetter
for McDonough brief, Trainor [head of FBI cyber division] directed all cyber info be
pulled.
I'd let Bill and Jim hammer it out first, though it would be best for D to have it before
the Wed WH session."
The GOP investigators explained that in these text messages, "D" referred to FBI Director
James Comey, and "McDonough" referred to Chief of Staff Denis McDonough.
"We are not making conclusions.
What we are saying is that the timeline is concerning enough to warrant the appointment
of an independent investigator to look at whether or not the Obama White House was involved
[in the Trump-Russia investigation]," a GOP congressional source said.
The GOP investigators also said that the CIA and FBI are supposed to be "independent
agencies," and noted that "coordination between political actors at the White House
and investigators would be inappropriate," raising questions about the level of involvement
of Obama White House officials.
Clearly, an investigation must be launched into the criminal lengths Obama went to in
the hopes of taking Trump down..

Dancing In Public | Clintus.tv - Duration: 12:11.- Good morning. It's our Sunday.
Sierra's in the kitchen making us waffles 'cause that's what
you do on the weekends, huh? - Yep.
- Sierra had a sleepover with one of her teammates last night
so she's gonna eat some breakfast with us and then
I think we're gonna get dressed for the day
and we're gonna go to Starbucks
and get one of the Crystal Ball Frappuccinos.
Excited for that?
- Yeah. - Yep. All right.
Thank you. - It's kinda easy.
- [Tiffany] (laughs) It's kinda easy?
It's like dessert for breakfast.
Little white chocolate chips.
Oh, in comes the strawberries.
- I'd rather have fresh strawberries.
- [Tiffany] Really? - Yeah.
- [Tiffany] Oh! - I don't know.
- [Tiffany] I was trying to be different.
- It's fine.
- [Tiffany] It's like restaurant.
- I think, I don't know.
- [Tiffany] You don't like the juice?
You don't want it to get soggy. - Yeah.
- [Tiffany] Are you so excited? - Yeah.
- [Tiffany] Hopefully they still have 'em.
- Yeah. - [Tiffany] Alright, let's go.
- We went a day too late-- - [Tiffany] And they ran out.
I have no idea. Looks good though.
Alright, give it it a try.
Peachy?
- Yeah. - [Tiffany] Is it good?
- I think I need to stir it around though
'cause all that liquid.
- [Tiffany] So what's your fortune?
- I don't know. (Tiffany laughs)
I think you got to drink it or something and get the ball.
'Cause there's like a ball...
- [Tiffany] So would you get it again?
That's the question.
Even though today's the last day.
Like it?
So our next stop is Home Depot.
I'm wanting one of those big mops and the,
what do you call those? Like mop buckets.
That you see in restaurants, the big yellow ones.
You know what I'm talking about, right?
- Mhmmm, yeah.
- To mop the garage. Is that weird?
- No.
- How else am I supposed to clean it?
- Clean the garage, yeah.
- [Tiffany] Good down to the last drop.
Haha, caught that.
(laughs) Brooms and mops.
- You need to take this off.
- [Tiffany] You called it a dancing mop.
- Yeah, a dancing mop. Like in movies.
- [Tiffany] Like in movies. (laughs)
- Yeah, they dance with the white mop and it's like.
- So as we were walking down this aisle those people who were
in front of us took the last one of those rolly things,
right here, that I was talking about.
Tandem mop bucket.
Last one. Not cool, huh?
- Use the grey one.
- [Tiffany] So they have this grey one.
But it's not quite--
- [Sierra] What you wanted. - [Tiffany] as good.
- It's not as big but it has wheels.
It doesn't have the wringy thing you wanted.
- [Tiffany] Right.
Oh wait. - Wait, here.
- [Tiffany] Oh, but this one doesn't have wheels.
- [Sierra] Well, what do you want? Wheels?
- [Tiffany] (sighs) It's a big area
so I was thinking wheels.
- So like you want it to be like you can just
drag the cart around and go.
- [Tiffany] Yeah. Just like that.
- Flip it around and start dancing with it.
- [Tiffany] That's gonna be you today in the garage. (laughs)
Get some music on.
Alright, so we decided to go, stop Sierra with your gum,
(Sierra and Tiffany laugh)
to Lowe's to see what kind of mop buckets they have.
- Yeah, those people stole the last one.
- I know. I'm like what's the chances of that?
So we'll see what they have.
We found one. The last one at Lowe's.
- Yeah, it has the nice little sign so you don't slip.
And it's got a little wringy thing so you can wring your mop.
- [Tiffany] A wringy thing?
- Yeah, a wringy thing and it's 31 quarts.
- [Tiffany] So sold? - Yeah.
- Back home now and it's lunch time.
We could've eaten while we're out but I had already boughten
stuff to make a pizza.
Been wanting to try this.
I'd seen this advertised and so we're gonna give it a try.
Sierra's gonna make it. - Thin crust.
- Thin crust.
So she's unrolling it.
You're supposed to keep it on that paper
and then bake it on that. Right?
How cute? Cute little pizza for you and I.
- [Sierra] Unroll it, do we need something to spread it though?
- [Tiffany] Probably.
Oh, you should've done a big smiley face or something fun.
- Tell me in the comments below would you choose meat,
like sausage, pepperoni, bacon, or veggies?
I'm kinda like in the middle.
I'd like bell peppers, olives, and sausage.
But I don't like pepperoni that much.
I'd rather have sausage over pepperoni.
Don't worry, you're supposed to keep the paper on there.
- [Tiffany] Yep.
- How long do I cook it for?
- [Tiffany] Ooh, 14 minutes I think.
14 to 18 so yeah, let's start at 14 and check it.
While our pizza's in the oven,
Baby's gonna get the dreaded bath.
You are way overdue, girl. - [Sierra] Yeah, she stank.
- [Tiffany] Yeah, stinky girl. She goes, "I don't like this."
- "Please don't make me take a bath.
"I really don't like it." - [Tiffany] I'm sorry Baby.
It's just one of those things that just has to be done.
- You need one. You should want a bath.
You stink.
She's like, "Not nice, guys. I don't like it.
"It's really cold." - [Tiffany] "I feel wet."
- [Sierra] She doesn't like to be wet at all.
She'll get in the creek though but she doesn't like this and
she doesn't like the pool.
- [Tiffany] She likes to be in control of the water.
- [Sierra] Yeah, exactly. Whereas that she can swim.
In the creek she just walk and splash and then get out.
Whereas that she has to swim and yeah,
she likes to be able to control it, I guess.
- [Tiffany] It's okay, Baby. I know.
- She's like, "I like you giving baths, Mom."
- [Tiffany] It's okay.
- Oh so fresh and so, look at my hands though.
- [Tiffany] Yeah.
- So gross. She sheds a lot.
- [Tiffany] And she doesn't let us brush her.
So just always dealing with that hair, huh?
Shake it off, girl. Get it all off.
- [Sierra] Shake it, shake it, shake it, shake it.
"No, I want to go in the grass." - [Tiffany] No, you can't roll.
- [Sierra] Get you all dirty again.
Her butt ends up shaking in the end.
- [Tiffany] There it is.
It's definitely done on top but I feel like the center is still
kinda doughy so that's why I pulled it out and did my
little trick on the skillet to kind crisp the bottom
and then I think we'll be alright.
Next time I'll try the not thin.
The regular crust.
All better, Baby?
So Sierra wanted to eat our lunch outside,
enjoy the beautiful weather while Baby's drying off.
- [Sierra] Mhmmm. - [Tiffany] Huh?
So we have to keep her tied up or else she'll go roll around in
the grass or the carpet.
- [Sierra] Or go inside. - [Tiffany] Yeah.
- [Sierra] Either one.
- [Tiffany] So she'll chill out here
for a little bit while she dries. How is it?
- Good. - [Tiffany] Good?
- Dough's good, cheese is good. - [Tiffany] Cool.
That pizza was delicious.
- Oh my gosh, so good. The cheese--
- [Tiffany] Everything. That's probably because you made it.
- Everything was so good.
- [Tiffany] So we'll make it again.
- It was like perfectly cooked, too.
Like it was so good. - [Tiffany] It was so good.
- Like I probably could've aten the whole thing.
- [Tiffany] She's like, "I had to share it with my mom
"and I could've ate the whole thing."
She's not quite sure what she's doing here. (laughs)
Alright, ready to mop the garage?
- Yep. - [Tiffany] Yep.
Do you have a method here? You gonna start by...
Is that really how you're doing it?
(laughs) - I don't know.
- [Tiffany] You don't know how to mop?
- No.
- [Tiffany] You gotta put some muscle into it.
- Ew, it's already dirty.
- [Tiffany] Yeah. It's gonna be bad. (laughs)
- What? I'm just like...
- [Tiffany] Oh, wow.
She really doesn't know what she's doing.
- Stop! (laughs)
- [Tiffany] So here's what it kind of looks like.
Not too horrible in here.
But definitely not clean.
Now, this on the other hand, this is where we park our cars.
And the last time that it rained,
when you pull in with the rainy, wet car,
that's what happens. So this one's pretty gross.
There is the after.
My garage smells so good. (chuckles)
And the RV garage.
Better.
You see the shine?
Dirt bike.
Alright, our work is done for the day.
We gave the dog a bath and we cleaned the garages.
So now, time for some sand volleyball.
- Yeah.
- [Tiffany] Baby's here to join us.
Even though we're putting her in the sand,
that probably isn't very smart.
- [Sierra] She's not gonna roll in it.
I don't think so. - [Tiffany] No.
- [Sierra] She'll maybe lay in it but that's just
gonna be on one side. That'll be fine.
- [Tiffany] Baby.
- Baby, you got sand in your mouth. Gross!
- [Tiffany] You just got a bath.
That wasn't very smart of us, huh?
I think she's gonna get another hose down when we get home.
- Ah, dang it.
- [Tiffany] She's loving it though.
Does that feel good?
Babies, does that feel good?
(dog barks in distance)
Oh, there's another doggy over there, huh?
(Baby barks)
(Tiffany and Sierra yell)
- All fluffy though.
- She like, "What're you guys doin'?"
- What do you want me for? Oh, okay.
- Alright, I think that's gonna conclude our girls weekend.
Did you have fun? - Yeah. I had a great weekend.
- Yeah. It was fun.
We're gonna spray down you, Baby.
- 'Cause she got dirt.
- [Tiffany] 'Cause you just got a bath.
- And she got dirt all over her.
- And then you and I are probably gonna go take a shower
'cause that sand it makes you feel gross.
- Yeah.
- But anyways, yeah, fun weekend.
Boys are coming home tonight. We'll probably be in bed.
But yeah, we'll see you-- - Whenever we see you.
- in the next vlog. - Yep.
- Goodnight. Bye. - Bye.
(upbeat music)

CHAIR: REPRESENTATIVE DEAN; HAVE YOU HAD A OPPORTUNITY TO
REVIEW THE MINUTES?
>> REPATIVE DEAN; I HAVE NOT
BUT IF YOU GIVE ME A SECOND
I'LL LOOK AT THEM
QUICK. MR. CHAIR; I MAKE A MOTION TO MOVE
THEM.
>> CHAIR: REPRESENTATIVE DEAN
MOVES THE MINUTES FROM
MANCH 28; ALL IN FAVOR
AYE. OPPOSED? THE MINUTES ARE APPROVED.
REPRESENTATIVE HOPPE.
MEMBERS RKS THE CHAIR WILL MOVE HOUSE
FILE 3958 TO LAY OVER FOR
POSSIBLE INCLUSION. THERE IS A
AMENDMENT; THE A1 AMENDMENT.
THE CHAIR WILL MOVE THE
AMENDMENT. REPRESENTATIVE HOPPE; IF YOU CAN INTRODUCE-ALL
THOSE IN FAVOR; AYE. OPPOSED?
THE AMENDMENT HAS BEEN
ADOPTED. REPRESENTATIVE HOPPE; COULD
YOU INTRODUCE YOURSELF AND
START WITH YOUR TESTIMONY.
>> REPRESENTATIVE HOPPE: I'M
JOE
HOPPE STATE REPRESENTATIVE FROM [INAUDIBLE COMMENTS] HOUSE
FILE 3958 IS WAS SOMETHING
ENTITLED TO SIMPLIFY THIS WHOLE
PROCEDURE; AND REDUCE THE FEE
FOR PEOPLE THAT ARE-FOR BANKS
LOOKING AT COURT JUDGMENTS
AND WITH THAT; WE CAN
CERTAINLY HAVE OTHER PEOPLE COME AND TALK
ABOUT IT. I KNOW THERE ARE
SOME CONCERNS; MR.
ELWOOD WORKED ON THIS
BILL; HIS LANGUAGE IS WHAT WE PUT IN THE
A1 AMENDMENT TO MAKE IT
AMENABLE TO THE LEGAL AID FOLKS
AND I THINK IT IS STILL A
WORK IN PROGRESS.
>> REPRESENTATIVE CONSIDINE:
THE AMENDMENT WENT FLYING
THROUGH BEFORE WE HAD A CHANCE
TO CHAT ABOUT
THAT. WHO'S AMENDMENT WAS IT?
>> CHAIR: THE AUTHORS
AMENDMENT.
>>
REPRESENTATIVE CONSIDINE: CAN WE ASK THE AUTHOR ABOUT
THAT >> REPRESENTATIVE HOPPE: THE
AMENDMENT WENT FLYING THROUGH;
THAT IS SUBSTANTIALLY MR.
ELWOOD'S AMENDMENT WHICH I
LIKE. I HAD THIS
LEGISLATION BROUGHT TO ME BY SOMEONE IN THE
DISTRICT THAT WORKS FOR A
BANK AND THOUGHT THIS IS A
SIMPLIFICATION OF THE WORK HE
GOES THROUGH ON A DAILY OR
WEEKLY PROCESS; BUT I LIKE TO
CHECK WITH MR. ELWOOD BECAUSE I
VALUE HIS OPINION; I ALSO CHECK
WITH MINNESOTA BANKERS AND
CREDIT UNIONS AND I CAN LET
MR. ELWOOD TALK ABOUT THE
AMENDMENT.
>> RON ELWOOD: LEGAL AID; I
WANT TO THANK
REPRESENTATIVE HOPPE SO MUCH FOR CHECKING WITH
US TO SEE IF
THERE ARE CONCERNS ON THE ISSUE AND BEING
SO OPEN TO OUR SUGGESTIONS.
THE AMENDMENT SIMPLY DOES THIS;
WE WERE CONCERNED THAT IF WE
REDUCED THE RENEWAL
JUDGMENT RATE TO SUCH A LOW LEVEL THAT
IT WOULD CREATE A UNINTENDED
AND PREVERSE INCENTIVE FOR DEBT
BUYERS TO RENEW THE
JUDGMENTS OVER AND OVER AGAIN; AND AS WE
KNOW THE FUTHER YOU GET FROM
THE ARINLINAL CREDITOR THE MORE
PROBLEMS HAPPEN AND SO
WE JUST FELT IF IT IS THE ORIGINAL
CREDITOR THAT MADE SINCE WHICH
IS WHAT THE BANK WAS AND THEN
WE SORT OF BALANCED THE SCALES
THIS WAY AND THAT IS WHAT THE
AMENDMENT DOES.
>> REPRESENTATIVE CONSIDINE:
THANK YOU; MR. CHAIR. DO
THEY NOT JUST ADD THAT ON TO THEIR
FEES WHEN THEY ARE COLLECTING?
>> MR. ELWOOD: IN OUR
EXPERIENCE IF THEY WOULD HAVE
TO RENEW-BY THE TIME THEY GOT
DOWN 10 YEARS IF THEY HAVE TO
RENEW THE JUDGMENT; THE HIGHER
FILING FEE HAS PROVEN TO BE A
DISINCENTIVE RENEWING THOSE
JUDGMENTS BECAUSE BY THAT TIME
THE EVIDENCE IS SO PHLEGMSY IS
UNLIKELY THEY COULD ACTUALLY
PROVE
IT. >> REPRESENTATIVE DEAN:
>>
REPRESENTATIVE UGLEM: THANK YOU; MR. CHAIR. TO MR. ELWOOD
OR REPRESENTATIVE HOPPE; SO I'M
ALL REDUCING THE FEES AND
EVERYTHING ELSE; AND WHAT
HAPPENS WHEN A JUDGMENT IS
ASSIGNED WHEN A ENTITY FOR
INSTANCE LIKE A BUSINESS SELLS
AND A NEW COMPANY TAKES OVER
YOU HAD A JUDGMENT AND SO IF
THE JUDGMENT IS ASSIGNED TO A
FUTURE ENTITY; THEY STILL HAVE TO PAY THE HIGHER RATE NOW; OR
WOULD THEY BE ABLE TO PAY $40?
>> MR. ELWOOD: MR. CHAIR;
REPRESENTATIVE UGLEM; IT
DOES SAY UNLESS IT IS THE
ORIGINAL CREDITOR THEY PAY THE HIGHER.
>> REPRESENTATIVE UGLEM:
THANK YOU: WELL; HAVE YOU CONCERNED
REPRESENTATIVE HOPPE ABOUT
KEEPING EVERYBODY EQUAL ON SOMETHING LIKE THIS?
>> REPRESENTATIVE HOPPE: MR.
CHAIR; REPRESENTATIVE UGLEM; WE
ARE STILL
CONSIDERING EVERYTHING. I DON'T
WANT TO-THIS BILL WILL BE LAID OVER
AND I'LL WILLING TO TALK
ABOUT ANY PARTS OF IT. I DON'T
WANT TO DO SMJ THAT
IS COUNTER PRODUCTIVE AND I THINK WHAT WE
ARE LOOKING FOR HERE IS MORE OR
LESS A SIMPLIFICATION AS
WELL AS LOWERING OF THE FEE BUT I'LL
WILLING TO TALK ABOUT
IT. >> CHAIR: MR. CARLSON.
>> THANK YOU; JOE
CARLSON; LEGAL RESEARCH
GOVERNMENT AFFAIRS IN ST. PAUL; AND
ONE OF THE GROUPS OF LAWYERS I
REPRESENT ARE CREDITOR LAWYERS;
THEY REPRESENT THE CREDITORS IN
THESE SITUATION JZ
FOUND OUT ABOUT THE
AMENDMENT LAST NIGHT WHEN IT WAS POSTED AND JUST
WANTED TO MAKE SURE WE
UNDERSTAND WHAT IS HAPPENING
HERE. I APPRECIATE AND HAVE
WORKED WITH LEGAL AID ON THE
ISSUE OF PURCHASE DEBT AND IN
FACT IN 2013 WE PASSED A
NEW STATUTE TO ADDRESS THE VERY
REAL PROBLEMS THROUGHOUT WITH
PURCHASED DEBT; THEY CALLED IT
[INAUDIBLE COMMENTS] AND PEOPLE
WERE MAKING A PAYMENT AND WE
TOOK A REAL EFFORT AND
REPRESENTATIVE HILSTROM CARRIED
THE BILL TO GET AFTER THAT
PROBLEM. THAT'S NOT WHAT WE
ARE TALKING ABOUT WITH THIS
LEGISLATION HERE.
REPRESENTATIVE
HOPPE'S UNDERLYING BILL WHICH WE
CERTAINLY SUPPORT; WOULD
BRING MINNESOTA INTO LINE WITH OTHER
JURISDICTIONS. WE CAN REALLY
FIND NO OTHER STATE THAT
CHARGES A FULL FILING FEE
SIMPLY TO RENEW A JUDGMENT.
THAT IS $360. ISSUES OF
EVIDENCE OF THE DEBT BEING
OLDER; THAT'S ALL IN THE PAST.
I HAD A JUDGMENT THAT HAS BEEN
DOCKETED FOR UP TO 10 YEARS.
YOU ARE NOT GOING TO RELITIGATE
THAT ISSUE. THE JUDGMENT IS
THERE; IN FACT IF IT IS A FRAUD
YULANT JUDGMENT WE HAVE A STATUTE THAT
PROTECTS THE CONSUMER AND IT IS A GOOD
THING WE HAVE IT; BUT 5408.14 GIVES A
CONSUMER THE OPPORTUNITY TO
CHALLENGE A
FRAUDULENT JUDGMENT. THE STATUTE OF
LIMITATIONS ON THAT IS THREE
YEARS AFTER THE JUDGMENT IS
DOCKETED. WE ARE TALKING ABOUT
A 10 YEAR WINDOW HERE; SO THEY
HAVEN'T CONTESTED AS
FRAUDULENT; THEY HAVEN'T
DISCHARGED IT IN
BANKRUPTCY. LAST YEAR WE FOUND OUT
THAT PEOPLE THAT WANT TO GO ON
DISCHARGE THE JUDGMENTS WERE
CHARGED THE $360. WE FIXED
THAT AND MOVED THAT DOWN TO 5.
WHAT WE ARE TALK ABOUT HERE IS
A VALID JUDGMENT IN PLACE FOR
UP TO 10 YEARS; AND TRYING TO
MAKE A DISTINCTION BETWEEN AN
ASSIGNED DEBT; NOT DEBT BUYER
JUST ANY ASSIGNED DEBT THAT CAN
HAPPEN FOR ANY REASON SO LONG
TAZ IS DONE BY STATUTE WHICH IS
548.13 AND
WE SAY EVERYBODY ELSE YOU PAY $40; BUT IF IT IS
ASSIGNED IN A BUSINESS
TRANSACTION OR OTHERWISE YOU
NOW UNDER THIS AMENDMENT BE
FORCED TO PAY THE $360 JUST TO
PROTECT YOUR RIGHTS AND PEOPLE
DO RENEW THESE DEBTS BUT THEY
DO IT WHEN IT ISN'T DISCHARGED
IN BANK ROPY AND HAVE THE
BELIEF THE
DEBTORS HATHE ABILITY TO PAY. SIMPLY SAYING
IN THAT SITUATION THE DEBTOR
WILLOW RR ANOTHER $360 ON TO
WHAT THEY ALREADY OWE SEEMS TO
BE A
DISCRIMINATION WE SHOULD THINK ABOUT AND I DID EXPRESS
THIS TO REPRESENTATIVE HOPPE
BEFORE THE COMMITTEE. WE ARE
FINE WITH LOWERING THE FEE BUT
TREAT EVERYONE THE SAME;
THAT IS OUR POINT. THANK YOU MR.
CHAIRMAN AND MEMBERS. ALSO; IF
THERE WAS A DIFFERENCE IN THE
COURT; IF THE COURT HAD TO DO
ADDITIONAL WORK ON THIS DEBT TO
RENEW THIS JUDGMENT I
UNDERSTAND THAT; THEY DON'T; IT
IS A ELECTRONIC FILING; YOU
CLICK A BUTTON AND IT IS
RENEWED. IT IS THE SAME FOR
EVERYBODY. THANK YOU MR.
CHAIR; HAPPY TO ANSWER
QUESTIONS. >> REPRESENTATIVE HOPPE: THANK YOU MR. CHAIR AND MR. CARLSON.
I HAVEN'T BEEN ABLE TO GET A
HOLD OF MY CONSTITUENT WHO WORK
FRZ THE BANK. I THINK I WILL
SEE HIM TOMORROW MORNING BUT
FAILING THAT IT WILL BE EARLY
NEXT WEEK. I'LL TALK ABOUT TO
HIM ABOUT THIS AND WILLING TO
WITH MR. CARLSON AND ELWOOD AND
ALL PARTIES INVOLVED AND SEE IF
WE CAN COME UP WITH SOMETHING
THAT CAN BE POSSIBLY INCLUDED.
>> CHAIR:
GREAT. >>
REPRESENTATIVE DEAN: THANK YOU; MR. CHAIR. SO; I'M
LOOKING AT THE FISCAL NOTE AND
WONDERING HOW THERE CAN BE NO
IMPLICATION IF WE ARE GOING
FROM $285 DOWN TO $40 AND I'M
JUST WONDERING IF THIS IS THE
TYPE OF THING THAT IS HARD TO
ACTUALLY MAKE A DETERMINATION
ON AND IT APPEARS THAT COURTS
HAVE SAID THAT THE AMOUNT OF
JUDGMENTS RENEWED AND UNKNOWN
AND CANNOT BE DETERMINED; WHICH
I MEAN; I AM TRYING TO
UNDERSTAND WHY THERE ISN'T A
FISCAL IMPLICATION WITH
THIS. IF MR. [INAUDIBLE COMMENTS] CAN
SPEAK TO THE FISCAL NOTE.
>> MR.
CHAIR; REPRESENTATIVE DEAN; I DID HAVE A
CONVERSATION WITH THE COURTS ABOUT THAT THIS
MORNING. I DO HAVE TO SAY
HOWEVER; THE FISCAL NOTES WERE
INADVERTENTLY LEFT OUT OF MY
PACKET TODAY SO DOPT HAVE ONE
IN FRONT OF ME. MY
CONVERSATION WITH THE COURTS
BASICALLY REVOLVEED AROUND THE
FACT THERE WASN'T
AIGATE NUMBER OF THESE AND DON'T THINK THE
AMOUNT OF REVENUE OR
DIFFERENCE IN REVENUE WOULD BE MATERIAL.
>> CHAIR: ANY OTHER QUESTIONS
FROM MEMBERS? ANY PUBLIC
TESTIMONY ON THIS BILL?
REPRESENTATIVE HOPPE; ANY LAST
REMARKS?
>> REPRESENTATIVE HOPPE: THANK
YOU FOR YOUR CONSIDERATION.
>> CHAIR: THE BILL IS
LAID OVER FOR POSSIBLE INCLUSION.
PLEASE KEEP WORKING ON IT AND
LET US KNOW OF ANY PROGRESS.
NEXT BILL TODAY WILL BE HOUSE
FILE 3260 WITH
REPRESENTATIVE LOHMER. REPRESENTATIVE LOHMER
YOU WISH TO MAKE THE MOTION FOR
POSSIBLE INCLUSION?
>>
REPRESENTATIVE LOHMER: THANK YOU MR. CHAIR; I MOVE
HOUSE FILE 3260 TO BE LAID OVER
FOR POSSIBLE AMCLUSION.
>> CHAIR: GO AHEAD WITH YOUR
PRESENTATION YOU HAVE
A AMENDMENT?
>> REPRESENTATIVE LOHMER: I
LIKE TO MOVE THE 3260-1
AMENDMENT.
>> CHAIR: THAT AMENDMENT JUST
CHANGES THE EFFECTIVE DATES?
>> REPRESENTATIVE LOHMER:
YES.
>> CHAIR: ALL IN FAVOR OF THE
A1 AMENDMENT; AYE.
? OPPOSED? THE AMENDMENT IS APPROVED GO
AHODE WITH YOUR TESTIMONY.
>>
REPRESENTATIVE LOHMER: THIS IS THE POSITION OF A AUTHORITY
LEGISLATION OF 2018. SO; THE
MINNESOTA COALITION AGAINST
SEXUAL ASSAULT DEVELOPED THIS
LEGISLATION WITH
PROSECUTORS FROM AROUND THE STATE AND
PUBLIC POLICY COMMITTEE.
MINNESOTA COUNTY ATTORNEYS
ASSOCIATION SUPPORTS THIS
LEGISLATION; AND THIS BILL
CREATES A LOOK BACK PERIOD OF
120 DAYS FOR POSITION OF
AUTHORITY. A PERSON IN A
POSITION OF AUTHORITY OVER A
CHILD UNDER THE AGE OF 18 IS
SOMEONE WHO IS ACTING IN
THE PLACE OF A PARENT AND HAS A
DUTY TO PROTECT THE WELFARE THE
CHILD. SO; HERE TO DISCUSS THE
BILL FURTHER IS; CARE LINE
PALMER WITH MIN COSA AND
SHE CAN ANSWER ANY QUESTIONS.
TURNING IT OVER TO MY
TESTIFIER.
>> CHAIR: MRS.
PALMER INTRODUCE YOURSELF AND
PROCEED. >> THANK YOU MR. CHAIR
AND MEMBERS AND THANK YOU
REPRESENTATIVE LOHMER FOR
CARRYING THE BILL; WE
APPRECIATE IT. I WANT TO THANK
THE COMMITTEE HEARING SO MANY
SEXUAL ASULT BILLS AND
INDULGEING ME COMING UP TO THE
TABLE TIME AFTER TIME
THIS SESSION; WE APPRECIATE YOUR SUPPORT AND EFFORTS. AS
REPRESENTATIVE LOHMER SAID
ESSENTIALLY WHAT THIS BILL DOES
IS CREATE A 120 DAY LOOK BACK
PERIOD AND THE WAY THIS WOULD
WORK IS CURRENTLY UNDER THE LAW
WE HAVE THERE POSITION OF
AUTHORITY WITHIN OUR CRIMINAL
SEXUAL CONDUCT STATUTE PER
TAINING TEACHERS
COACHES; ANYONE CHARGED WITH THE CARE
TAKING OF A CHILD. WHEN YOU
SEND YOUR CHILD TO SCHOOL; WHEN
YOU SEND TO SPORTS THINGS
LIKE THAT THEY ARE UNDER A
POSITION OF AUTHORITY AND THIS
PARTICULAR PART THE STATUTE
APPLIES TO YOUTH 16 AND 17
YEARS OLD. THE WAY THE
STATUTE IS WRITTEN NOW IS IT SAYS A
APPARENT CHARGES SOMEBODY
ELSE WITH A POSITION OF AUTHORITY SO
WHEN YOU SEND YOUR STUDENT TO
SCHOOL YOU ARE GIVING THE
SCHOOL THAT AUTHORITY. WE ARE
DOING A COUPLE OFTHIS IN
THIS BILL. FIRST OF ALL; WE ARE
ALSO RECOGNIZING SITUATIONS
IN WHICH SOMEBODY MIGHT BE
ASSUMING A POSITION OF
AUTHORITY; SO IT COULD BE
SOMEBODY WHO SAY STOOZ THE
CHILD I'M YOUR TUTOR OR MENTOR
BUT THEY HAVEN'T
RECEIVED THAT EXPRESSED CONTRACT WITH THE
PARENTS TO DO SO. THAT
HAPPENS SOME CASES SO WE ARE ADDING THE
LANGUAGE INTO THE STATUTE. AND
IN REGARD WITH THE LOOK BACK
PERIOD; IF FOR XHMP A TEEPER;
COACH; SOMEBODY IS GROOMING THE
STUDENT OVER THE COURSE OF
THE SCHOOL YEAR WITH THE
ANTICIPATION THE SUMMER HOLIDAY
IS COMING AND ACT UPON
THOSE INTENTION THIS HAS THE
BOOK BACK PERIOD THAT SAYS YOU HAVE
BEEN IN THE ROLE IN THE PAST
120 DAY AND CONSIDER YOU IN A
POSITION OF AUTHORITY AND
AGAIN; THESE SITUATIONS DO
HAPPEN. IT IS SPECIFIC BUT
HAPPY TO ANSWER QUESTIONS.
>>
REPRESENTATIVE CONSIDINE: COULD YOU GO MORE INTO THE 120
DAYS S IT JUST BASICALLY
SUMMER VACATION?
>> MRS. PALMER: YEAH; IT IS
REALLY
BASICALLY THE TIMEFRAME WE CAME TO AS AN
AGREEMENT-THE BILL HAS BEEN AROUND FOR A
FEW SESSION JZ SO IT THROUGH A
COUPLE COMMITTEES AND THIS IS
THE TIMEFRAME WE FOUND
EVERYBODY CAN AGREE UPON AND IT
IS A PRETTY GOOD AMOUNT OF
TIME.
>>
REPRESENTATIVE CONSIDINE: THANK YOU; MR. CHAIR.
>> CHAIR: ANY OTHER QUESTIONS
FROM MEMBERS? ANYBODY FROM THE
PUBLIC WISH TO TESTIFY ON
THIS BILL? WITH THAT; I WILL LAY
THE BILL OVER FOR POSSIBLE
INCLUSION. THANK YOU.
>> THANK YOU MR. CHAIR AND
MEMBERS. .
>> CHAIR:
REPRESENTATIVE HILSTROM. YOU WISH TO MOVE
YOUR BILL FOR POSSIBLE
INCLUSION? >> REPRESENTATIVE HILSTROM: I
DO; MR. CHAIR.
>> CHAIR: PLEASE PROCEED.
>>
REPRESENTATIVE HILSTROM: THIS IS THE ADMINISTRATION BILL
AND SO WITH ME IS THE
DEPARTMENT OF PUBLIC SAFETY.
IT REALLY HAS SOME
TECHNICAL CHANGEATIZE IS MAKING TO THE
PREDATORY REGISTRATION AND ADDITIONAL INFORMATION THEY ARE
GOING TO GET ACCESS TO SO I
WILL ASK THEM TO BRIEFLY GO
THROUGH THE ADDITIONAL PIECES THAT THEY WOULD LIKE THIS
COMMITTEE [INAUDIBLE COMMENTS] MADE THROUGH CIVIL LAWS
ALREADY; WE TALKED ABOUT THE
DATA ACCESS. THERE WAS NO
AUDIBLE DESCENT AND SO WITH
THAT I WOULD LIKE TO TURN IT
OVER TO MY TESTIFIER; MR.
CHAIR.
>> CHAIR: PLEASE INTRODUCE
YOURSELF AND PROCEED.
>> MR. CHAIR; MEMBERS; MY NAME
IS KATIE ENGLANDER WITH THE
BUREAU CRIMINAL
APPREHENSION. I WILL WALK THROUGH HOUSE FILE
3578. SECTION 1 AUTHORIZES THE
USE OF THE DRIVERS LICENSE
PHOTOGRAPH TO LOCATE A
INDIVIDUAL REQUIRED TO REGISTER
AS A PREDATORY OFFENDER.
SECTION 2 ADDS A COUPLE
DEFINITIONS USED LATER IN THE
BILL. SECTION 3 REFORM ATS THE
LIST OF OFFENSES THERE AND
ADDS OFFENSES THAT IS THE BASIS FOR
REGISTRATION. SECTION 4;
MODIFYS THE NAME OF A FORM THAT
IS REFERENCED IN STATUTE AND
DIRECTS THAT WHEN A
INDIVIDUAL DOES NOT HAVE A
CORRECTIONS AGENT THEY ARE TO WORK WITH
LOCAL
LAW ENFORCEMENT AGENCY IN ORDER TO MEET THE REGISTRATION
REQUIREMENTS. SECTION 5; IS
ABOUT-HAS
SEVERAL PROVISIONS; THE FIRST IS REQUIRE COLLECTION
OF DNA SAMPLE AS PART
OF REGISTRATION. THERE IS
A TECHNICAL FIX TO ALLOW THE
BCA TO NOTIFY LAW ENFORCEMENT OF A
INDIVIDUAL'S NEED TO REGISTER
RATHER THAN PROVIDE WITH A
COPY. THERE ARE SEVERAL
CHANGES ABOUT HOW WE CALCULATE
THE AMOUNT OF TIME THAT A
INDIVIDUAL HAS TO RETURN THE
ANNUAL
VERIFICATION FORM. COUNTY NOW IS DONE FROM THE
DATE OF RECEIPT. IT IS
IMPOSSIBLE FOR THE BUREAU TO
KNOW WHEN A INDIVIDUAL RECEIVES
THEIR REGISTRATION
OR VERIFICATION FORM; SO
THE CHANGES ARE TO ACCOUNT FROM THE
TIME ON THE
VERIFICATION FORM ITSELF WHICH IS THE DATE OF
MAILING. THERE IS NEW
AUTHORITY BEGINNING ON LINE
8.6; THAT AUTHORIZES EITHER
CORRECTIONS AGENT OR LAW
ENFORCEMENT AUTHORITY TO
DETERMINE A INDIVIDUALS INCOME
COMPLIANCE WITH THE
REGISTRATION AT ANY TIME AND AT
ANY FREQUENCY. IT ALLOWS LOCAL
LAW ENFORCEMENT TO
DETERMINE COMPLIANCE EVEN
IF THE INDIVIDUAL HAS A
CORRECTION AGENT ASSIGNED. THE LAST PART
OF SECTION 5 TALKS ABOUT
HAVING A YEAR FOR US TO COLLECT THE
DNA SAMPLE FOR THOSE WHO HAVE
NOT PREVIOUSLY PROVIDED ONE.
SECTION 6; IS WHERE WE TALK
ABOUT THE ADDITIONAL ITEMS OF
DATA THAT WE WOULD LIKE TO
COLLECT ON INDIVIDUALS.
THERE IS ONE CHANGE TO EXISTING LAW;
WHICH IS RIGHT NOW A 2NDARY
ADDRESS FOR EXAMPLE; A CABIN;
IT IS LIMITED TO THOSE LOCATED
WITHIN MINNESOTA; THE CHANGE
EXPANDS TO INCLUDE THE SAECDARY
ADDRESS NO MATTER WHERE IT IS
LOCATED; SO WISCONSIN;
DAKOTA; IOWA; WOULD COUNT AS WELL.
SECTION 7; GIVES AUTHORITY TO
USE ALTERNATIVES TO SOMEONE
SIGNING A DOCUMENT INCLUDING A
ELECTRONIC FORMAT. SECTION 8
IS ABOUT SOMETHING CALLED;
INTERNATIONAL MEGAN'S LAW WHICH
IS FEDERAL REQUIREMENT FOR
INDIVIDUALS REQUIRED TO
REGISTER TO HAVE NOTIFY THE
FEDERAL GOVERNMENT OF THEIR
TRAVEL PLANS OUTSIDE OF THE
COUNTRY IN A CERTAIN AMOUNT OF
TIME. THIS
INFORMATION IS FORWARDED TO THE FEDERAL
GOVERNMENT WHO GIVES THE
DESTINATION COUNTRY THE
OPPORTUNITY TO DETERMINE WHETHER OR NOT THEY ARE GOING
TO ALLOW THAT INDIVIDUAL TO
ENTER ON ARRIVAL. SECTION 9;
MODIFYS PENALTY LANGUAGE BASED ON A ROONT MINNESOTA SUPREME
COURT DECISION. SECTION 10;
TALKS ABOUT THE FACT THAT
FAILURE TO REGISTER WILL NOW
INCLUDE NOT COMPLY WG THE NEW
INTERNATIONAL TRAVEL REQUIREMENTS; IT ALSO ADDS
LANGUAGE THAT SAYS IF A
INDIVIDUAL IS NOT IN
COMPLIANCE AT THE END OF THE
REGISTRATION PERIOD THEIR PERIOD OF TIME
THEY ARE REQUIRE TODAY REGISTER
WILL BE EXTENDED FOR TWO
YEARS TO GIVE US THE OPPORTUNITY TO
UMXH INTO COMPLIANCE. SECTIONS
11 AND 13; ARE DAT A SHARING
PROVISIONS TO MATCH LANGUAGE
PASSED SEVERAL YEARS AGO
AUTHORIZING PROBATION AGENTS TO
SHARE INFORMATION WITH CHILD
PROTECTION. THIS
JUST CLEANS THINGS UP TO MAKE SURE THE
SHARING IS ACTUALLY
AUTHORIZED. SECTION 12; CLARIFIES THAT
WHEN A PERSON DOES NOT RETURN A
VERIFICATION FORM OR
HAS [INAUDIBLE COMMENTS] THAT THE
BUREAU MAY MAKE INFORMATION
ABOUT THE INDIVIDUAL AVAILABLE
TO THE PUBLIC BECAUSE THEY ARE
OUT OF COMPLIANCE. WITH THAT;
I'M HAPPY TO ANSWER QUESTIONS.
>> CHAIR: ANY QUESTIONS FROM
THE MEMBERS?
>>
REPRESENTATIVE [INAUDIBLE COMMENTS] NOT A
QUESTION; BUT RATHER THANK YOU. I DID
PREDITARY OFFEND
TRACKING AND THERE ARE A LOT OF TIMES
YOU ARE LOOKING AT IT AND GOING IF
THIS IS ALL WE ARE TRACKING
WITH; THINGS NEED TO BE
TIGHTENED UP SO I APPRECIATE
WHAT REPRESENTATIVE HILSTROM IS
PUTTING FORWARD HERE.
>> CHAIR: ANY OTHER QUESTION
FROM THE MEMBERS?
>> REPRESENTATIVE
BECKER FINN: THANK YOU; MR. CHAIR AND I
ALSO WANTED TO THANK YOU FOR
BRINGING THIS FORWARD. I KNOW
IN RECENTLY IN MINNESOTA THERE
ARE A COUPLE CASES WHERE WE
HAD-I DON'T KNOW IF THEY WERE
PREVIOUSLY OFFENDERS BUT HAD
CASES WHERE PEOPLE KIDNAP
CHILDREN AND TAKE THEM TO
CABINS AND SECOND HOMES
AND THINK THAT WILL BE REALLY
HELPFUL IN KEEPING TRACK OF
WHERE FOLKS ARE AND WHEN WE DO
HAVE INCIDENTS TRYING TO FIGURE
OUT IF THERE IS A REOFFENSE WE
HAVE
THAT INFORMATION READILY AVAILABLE SO THANK YOU.
>>
REPRESENTATIVE HILSTROM: THERE IS A A1 AMENDMENT AND
THIS IS AT THE REQUEST OF
DEPARTMENT OF CORRECTION JZ
THEY ARE HERE TO
SPEAK TO THAT IF YOU WOULD LIKE THEM TO SPEAK
TO THE A1 AMENDMENT.
>> CHAIR: IF THEY ARE
WILLING-I SEE COMMISSIONER
ROY HERE. GOOD MORNING. PLEASE
INTRODUCE YOURSELF AND
BEGIN. >> TOM ROY: COMMISSIONER OF
CORRECTIONS. REFERENCES PAGE
11 AFTER LINE 5 WE HAVE SOME
CONCERNS ABOUT
THE TRAVEL LANGUAGE AND SOME OF OUR FOLKS
VOICED A CONCERN THAT THIS
MIGHT LEAD THOSE FOLKS WHO ARE
ON SUPERVISION TO BELIEVE THAT
THEY CAN TRAVEL AND WE WOULD
OFFER LANGUAGE THAT WOULD
SPEAK TO THAT; BECAUSE WE FEEL THAT
EXPECTATION IS NOT REASONABLE.
THERE ARE PEOPLE UNDER
SUPERVISION WHO SHOULD NOT
TRAVEL; AND I CAN THINK OF A
CASE I HAD AS PROHIBITION
OFFICER A GENTLEMEN WANTED TO
RESPOND A WEEK IN THE BAHAMAS
AND HAD A NO DRINK CLAUSE AND
ALSO OWED
RESTITUTION AND MY COMMENT TO HIM WAS IT WOULD BE
DIFFICULT TO MONITOR THE
DRINKING AND BEFORE YOU SPEND
MONEY ON A BAHAMAS TRIP YOU
SHOULD PAY YOUR RESTITUTION.
WE ALSO LOSE JURISDICTION WHEN
THEY
TRAVEL INTERNATIONALLY. WE DON'T HAVE TREATEES WITH A
NUMBER OF COUNTRIES SO THINK IT
WOULD BE INCUMBENT TO HAVE THE
LANGUAGE THAT I CAN NOW READ
INSERTED AFTER LINE 5; PAGE 11;
1.3; A PERSON REQUIRED TO
REGISTER UNDER THIS SECTION WHO
IS ASSIGNED A CORRECTION AGENTS
MUST RECEIVE THE
CORRECTIONS AGENTS APPROVAL FOR ALL TRAVEL;
NOTHING IN THE SUBDIVISION
REQUIRES A CORRECTIONS AGENT TO
APPROVE OF TRAVEL THAT IS
INCONSISTENT WITH THE TERMS OF
THE OFFENDERS SUPERVISION. I
THINK IT JUST MAKES SENSE.
>> REPRESENTATIVE HILSTROM: THANK YOU; MR. CHAIR. THIS WAS
A DEPARTMENT BILL AND
DIFFERENT DEPARTMENT AMENDMENT AND I HAVE
NO ISSUE ADDING THAT.
>> CHAIR: ANY QUESTIONS ON THE
AMENDMENT? ALL THOSE IN
FAVOR- >>
REPRESENTATIVE [INAUDIBLE COMMENTS] I HAD THOSE
CONVERSATIONS AS WELL AS A
DEPUTY WHEN THEY START TALK BTH
TRAVEL AND TELL THEM NO; YOU
TALK TO YOUR AGENT FIRST
OTHERWISE WE WILL BE
TRACKING YOU DOWN AND YOU WILL BE IN
VIOLATION. I SUPPORT IT AS
WELL.
>> CHAIR: ALL IN FAVOR OF THE
A1; AYE. OPPOSED? THANK
YOU. MOTION IS-THE AMENDMENT IS
APPROVED. >>
REPRESENTATIVE HILSTROM: NOTHING ELSE.
>> CHAIR: NO OTHER
TESTIFIERS? ANY OTHER QUESTIONS FROM THE
COMMITTEE? ANY TESTIFIERS FROM
THE PUBLIC THAT WISH
TO TESTIFY? THE BILL WILL BE
LAID OVER FOR POSSIBLE INCLUSION.
>> REPRESENTATIVE
HILSTROM: THANK YOU; MEMBERS.
>> CHAIR:
REPRESENTATIVE CHRISTENSEN; WELCOME
TO COMMITTEE. THE CHAIR WILL MOVE
HOUSE FILE 3885 FOR
POSSIBLE INCLUSION. REPRESENTATIVE
CHRISTENSEN; PLEASE PROCEED.
>>
REPRESENTATIVE CHRISTENSEN: HOUSE FILE 3885 IS I THINK A
GOOD STEP IN SOMETHING WE CAN
DO RIGHT NOW TO MAKE SURE OUR
SCHOOLS ARE SAFE. IT PROVIDES
FOR GRANTS FOR SCHOOLS TO DO
SECURITY AUDITS ON THEIR SCHOOL
TOOZ FIGURE OUT WHAT ARE SOME
STEPS THEY CAN TAKE RIGHT NOW
TO IMPROVE THE
SCHOOL SECURITY; SOME OF THE STEPS COULD BE
UPGRADES AND SOME STEPS ARE
PROCEDURAL THINGS THAT
DONT COST MONEY. I THINK THIS IS A
GOOD BILL AND HAPPY TO DISCUSS
WITH MEMBERS.
>> CHAIR. : THANK YOU; DO WE
HAVE QUESTIONS FROM MEMBERS?
>> REPRESENTATIVE CONSIDINE: THANK YOU; MR. CHAIR. WHY DO
WE HAVE TWO BILLS THAT SEEM TO
DO THE EXACT SAME THING?
>>
REPRESENTATIVE CHRISTENSEN: MR. CHAIR; I THINK GREAT MINDS
THINK ALIKE. THE BILLS ARE
SIMILAR; THEY ARE
DAFTED DIFFERENTLY; BUT I THINK THEY
ARE BOTH GET AT THE SAME ISSUE
AND ARE GOOD IDEAS.
>>
REPRESENTATIVE CONSIDINE: CAN WE NOT GET TOGETHER AND
JUST MAKE ONE BILL INSTEAD OF
DOING THIS TOGETHER?
>> CHAIR: TO THE
TESTIFIERS. >> REPRESENTATIVE CHRISTENSEN:
I THINK THAT WILL BE THE
END RESULT AND WHY WE ARE KIND OF
HEARING THE BILLS
TOGETHER HERE.
>> CHAIR: ANYTHING ELSE
REPRESENTATIVE CONSIDINE?
>> REPRESENTATIVE CONSIDINE: YOU DO KNOW YOU ARE ON
THE SAME PARTY; RIGHT?
>> REPRESENTATIVE CHRISTENSEN:
YES.
>>
REPRESENTATIVE LUCERO: THANK YOU; MR. CHAIR AND THANK
YOU TO BOTH BILL AUTHORS
OF YOUR TWO BILLS. I KNOW THAT AS
INDEPENDENTLY EFFECTED OFFICIALS WE HAVE OUR OWN IDEAS
WHEN TWEE DRAW BILLS AND MAY
NOT KNOW WHAT OTHERS ARE
WORKING ON SO APPRECIATE YOUR
EFFORTS BOTH OF THE BILLS ARE
COMING BEFORE THE
COMMITTEE TODAY. THE QUESTION I HAVE FOR
REPRESENTATIVE CHRISTENSEN IS;
I'M NOT FAMILIAR WITH THE
AMERICAN SOCIETY FOR
INDUSTRIAL SECURITY AND THAT IS THE
ORGANIZATION THAT IS REFERENCED
IN TERMS OF HAVING TO HAVE A
CERTIFIED
PROTECTION PROFESSIONAL CERTIFICATION IN ORDER TO QUALIFY FOOTOO
PERFORM SO WONDER IF YOU CAN ELABORATE
ON WHAT THAT ORGANIZATION IS
AND THEIR INVOLVEMENT IN THIS
PROCESS. THANK YOU.
>>
REPRESENTATIVE CHRISTENSEN: MR. CHAIR AND REPRESENTATIVE
JESSUP COULD MAYBE ADD MORE TO
THAT BUT BASICALLY THEY ARE THE
STANDARDS ORGANIZATION THAT
PROVIDE ACCREDITATION IN THIS
FIELD. THE RESULTS THAT WE
WILL BE LOOKING FOR AND ATYPE
OF ANALYSIS THAT WOULD BE DONE
IS VERY SIMILAR TO WHAT WAS
ROONTLY DONE BEFORE THE CAPITAL
RESTORATION ANALYZING THE SECURITY OF THE CAPITAL AND
STATE GOVERNMENT COMPLEX HERE.
>> REPRESENTATIVE LUCERO: NO
FOLLOW UP;
JUST WANTED OKNOW MORE ABOUT THE
ORGANIZATION. >> REPRESENTATIVE JESSUP:
THANK YOU. THANK YOU CHAIR;
THANK YOU MEMBERS FOR
COMMITTEE; MY APOLOGY FOR BEING
LATE. THANK YOU REPRESENTATIVE
CHRISTENSEN FOR BEING HERE ON
TIME AND I WILL JUST
SAY REPRESENTATIVE CONSIDINE; THIS
IS A UNIQUE EXPERIENCE. IT IS
QUITE A
PLESERABLE EXPERIENCE I WILL HAVE TO SAY; TAG TEAM WITH
A FELLOW REPRESENTATIVE; I GOT
TO SAY; THAT'S NOT A
BAD-THAT MAY NOT BE ABAG BAD GIG TO
CONSIDER FOR THE FUTURE BUT IT
ISCOURAGE NCOURAGING WE BOTH CAME UP WITH SIMILAR IDEAS AND
THINK THAT JUST
EMPHASIZES REALLY THE I THINK FOR ALL OF
US THIS WHOLE ISSUE OF SCHOOL
SAFETY IS WEIGHING ON THE MINDS
NOT ONLY OF MY
REPUBLICAN COLLEAGUE JZ THE
DEMOCRAT SIDE AS WELL; ALL OF US SO THIS IS A
INITIATIVE AND OPPORTUNITY TO
PUSH FORWARD.
REPRESENTATIVE CHRISTENSEN MENTIONED WE HAD GONE THROUGH BEFORE I HAD COME
REALLY SOME
CAPITAL SECURITY ASSESSMENT FOR THIS BUILDING
AND ALL THAT REPRESENT US
AS WELL AS WORK IN THIS
PARTICULAR CAPITAL AND THAT WAS WHY THE
ENTRANCE IN FRONT OF THE
CAPITAL WAS REMOVED. NOW IT IS
WALKING PATHS OUT THERE AND
THAT WAS PART OF THE SECURITY
EFFORT. AS WE
THINK THROUGH THAT; IF WE CAN DO THAT
FOR THE CAPITAL DURING THE
INVESTMENT WE MADE FOR THE
CAPITAL; WE NEED DO WHAT IS
SIMILAR FOR OUR SCHOOL AND
SCHOOL SYSTEMS ACROSS THE
STATE. I DON'T THINK
ANYONE HERE WOULD SAY THE LIVES OF THE
CHAIR FAIR MORE VALUABLE THE
LIVE FRZ ALL OF US SO THAT IS
WHY WE ARE HERE TOORB
TOGETHER. >> >> REPRESENTATIVE PINTO: THANK
YOU; MR. CHAIR AND THANK YOU TO
THE AUTHORS FOR BRINGING
THIS FORWARD. I FIND IT STRIKING WE
HAVE DOUBLED THE NUMBER OF
BILLS AS USUAL E; WE HAVE NOT A
SINGLE TESTIFY ON BEHALF OF
EITHER BILL. DO YOU HAVE
EXPERTS IN SCHOOL SAFETY;
THE YOUTH WHO WILL BE PROTECTED; I
FIND IT STRIKING THAT YOU JUST
HAVE THE TWO OF YOU AND DOUBLE
THE NUMBER BUT NOT SINGLE
PERSON TESTIFYING SAYING THIS IS THE RIGHT
STEP. I NOTICE THERE IS A APPROPRIATION THAT
IS 2 MILLION;
2 MILLION BUCKS THAT THAT IS THE RIGHT STEP TO
BE KEEPING STUDENTS SAFE. ANY
COMMENTS ON THAT I OFFER THAT
TUPE THE TWO TESTIFIERS.
>> CHAIR: TO THE TESTIFIERS.
>> MR.
CHAIR; REPRESENTATIVE PINTO; I THINK WE HAD A LOT OF
CONVERSATION WITH SCHOOL
OFFICIALS AND SCHOOL
DISTRICTS FOLKS AND THINK WE HEARD FROM
THEM PREVIOUSLY AND EDUCATION
COMMITTEE WHERE THOSE
STAKEHOLDERS FREQUENT; BUT I
THINK THIS IS A THOUGHT OUT
PROPOSAL THAT IS TALKED ABOUT
WITH SCHOOL DISTRICTS. THIS I
THINK IS SOMETHING WHERE WE GET
A LOT OF BANG FOR OUR BUCK FOR
A REASONABLY MODEST INVESTMENT
OF $2 MILLION; ANYWHERE FROM A
HUNDRED TO 400 SCHOOLS COULD
UTILIZE THIS GRANT PROCESS AND
DO AND KNOW HOW BEST TO INVEST
THEIR MONEY AS WELL AS
DO THINGS THAT COST LITTLE TO NO
MONEY THAT ARE JUST PROCEDURAL
CHANGES. >> REPRESENTATIVE PINTO: YES;
MR. CHAIR. SO IN THE
PUBLIC SAFETY COMMITTEE WE DO HAVE
FOLKS WHO HAVE THEMSELVES
EXPERIENCED IN PUBLIC SAFETY
AND I'M PROSECUTOR AND SPEAK
FROM THAT PERSPECTIVE; YOU
HEARD FROM
REPRESENTATIVE GAROFALO AND DON'T KNOW THE
BACKGROUND OF THE BILL
AUTHORS BUT I UNDERSTAND THE THOUGHT
THERE WILL BE A LOT OF-THIS
WILL BE A USEFUL THING; BUT IF
YOU HAVE BEEN TALKING TO
SCHOOLS AND EXPERTS IN SCHOOL
SAFETY MY THOUGHT IS I
WOULD FIND IT MORE CREDIBLE WITH
REEXPECT TO HEAR
FROM THEM SAYING THIS IS WHAT WE NEED
THEN TO BE HEARING FROM THE
AUTHORS. WE NEED TO HEAR FROM
YOU; BUT IF THIS TRUEY IS
SOMETHING DESIRED I EXPECT WE
WOULD HEAR THAT FROM FOLKS AND
THE OTHER QUESTION IS; DO YOU
HAVE SIMILAR BILLS TO ADDRESS
AUDITS AND SAFETY IN THE OTHER
LOCATION WHERE MASS SHOOTINGS
OCCURRED SO THINKING IS THERE A
BILL REGARDING CONCERT HALLS;
NIGHT CLUBS; CHUNCHS; THE
PRAYER CIRCLES THAT OCCURRED
THERE; PARKS AND HIGHER ED
AREAS; SO I APPRECIATE THE
SELECTION OF THIS
PARTICULAR AREA. THE YOUTH ARE BEING
PROTECTED HERE I
HEAR THEM ASKING FOR A LOT OF
OTHER THINGS AND I WANT TO MAKE
SURE OF COURSE WE ARE PROVIDING THAT
SAFETY AND OTHER LOCATIONS AS
WELL SO WONDER WHEN THOSE BILLS
WILL BE COMING OUT.
>>
CHAIR: REPRESENTATIVE JESSUP ARE YOU TAKING THAT
ONE?
>>
REPRESENTATIVE JESSUP: I THINK WE ARE ON A PROGRESSION
HERE REPRESENTATIVE PINTO. WE
HAVE SEEN EVERY SINCE 911; 2001
WE FOCUSED UPON AIRPORT
SECURITY AND MAKING SURE WE
WILL NEVER HAVE ANOTHER 911
AGAIN. THAT WAS PROBABLY STEP
ONE. SINCE THEN WE AS A
SOCIETY EVOLVED. THINK OF THE
STADIUMS AND CHECKS WE GO
THROUGH WHEN WE GO INTO A
STADIUM EITHER FOR A SPORTS
EFFORT OR ENTERTAINMENT. I
LOOK AT-I LIKE
YOUR QUESTION AND LOOK AT AND SAY THIS IS A
EVOLVING PROCESS FOR US ALL AND
I WOULD HAVE TO SAY QUITE
HONESTLY I THINK
SCHOOLS ARE THE NEXT ON THE
PRIORITY LIST. PERHAPS THEY SHOULD HAVE BEEN
EARLIER BUT THEY NEED TO BE UP
NOW AND WE NEED A
BASELINE; HOW SAFE ARE THE SCHOOLS? ALL OF
US ESPECIALLY THOSE THAT HAVE
CHILDREN OR HAD CHILDREN GO
THROUGH THE SCHOOLS WE ALL
SAY; OUR SCHOOLS ARE
REAL SAFE; WELL; THAT IS BECAUSE WE ARE IN
A TRUSTING ENVIRONMENT. AT
LEAST IN MY KIDS ARE
GROWN NOW SO I GIVE THAT CONTEXT. YOU
MOST LIKELY HAVE CHILDREN IN
SCHOOL REPRESENTATIVE PINTO; SO
I HAVE TO BACK MY CONTEXT UP
SLIGHTLY; BUT I WILL SAY THAT
THERE IS OFTEN WE TALK ABOUT IN
COMMUNITIES WE REALLY WANT A
LEVEL OF TRUST BETWEEN
FAMILIES AND BETWEEN THE SCHOOLS FOR
WHICH THE CHILDREN ATTENDS AND
I FELT THAT BUT I LOOK NOW AT A
SCHOOL AND I DID AND
TURCHED BASE WITH
SUPERINTENT END AND LOOK AT THE SCHOOLS AND DON'T WANT TO LOOK AT IT FROM
THIS CONTEXT BUT IS THE SCHOOL
PENETRABLE FROM THE OUTSIDE TO
DO DAMAGE INSIDE AND THAT IS
NOT WHERE I WANT TO PUT MY
MIND BUT THINK WE ARE IN A POSITION
NOW IN SOCIETY WHERE WE NEED TO
DO THAT AND THE BILLS
THAT REPRESENTATIVE CHRISTENSEN AND
I HAVE BEFORE YOU IS REALLY IF
WE CAN DO AUDITS ON SCHOOLS AND
AGAIN; SOME SCHOOLS HAVE
ALREADY GONE THERE AND
FOCUSED UPON SCHOOL SAFETY BUT THERE
ARE OTHER SCHOOLS IN THE STATE
OF MINNESOTA THAT HAVEN'T HAD
THE OPPORTUNITY OR FUNDING. WE
NEED TO ESTABLISH
A BASELINE AND WHERE WE ARE AT TODAY
WITH THE SAFETY IN THE SCHOOLS AND
IT ISN'T JUST THE
BUILDINGS. IT IS ALSO THE CRISIS
MANAGEMENT PLANS IN PLACE.
WHAT ARE THE
PROCEDURES THAT OCCUR FOR A SCHOOL IF THEY
ENCOUNTERED A DISRUPTION AND THAT COULD BE A TORNADO AS WELL
AS SOMEONE COMING TO THE SCHOOL
THAT SHOULDN'T BE
THERE; BUT I THINK WE NEED TO ESTABLISH A
BASELINE FOR THE SCHOOLS AND
THIS IS A FIRST STEP TO GET
AFTER THAT AND TO
YOUR POINT; PERHAPS WE NEED TO DO SIMILAR
ONCE WE REALLY TACKLE THE
SUBJECT AT SCHOOLS AND LOOK
ELSEWHERE FOR OTHER VENUES THAT
ARE PUBLIC VENUES.
>> REPRESENTATIVE PINTO: ARE
THESE BILLS BEING LAID OVER FOR
POSSIBLE INCLUSION OR REMIND ME
OF THE PATH?
>> CHAIR: THEY ARE BOTH
GOING TO BE LAID OVER.
>> REPRESENTATIVE PINTO: THANK
YOU MR. CHAIR. THANK YOU FOR
THE TESTIFIERS. I THINK
I'M DONE. THANK YOU MR. CHAIR.
>> CHAIR: NEXT ON THE LIST; WE
HAVE REPRESENTATIVE O'NEILL.
>>
REPRESENTATIVE O'NEILL: THANK YOU MR. CHAIR. I WAS
GOING TO ADDRESS SOMETHING
REPRESENTATIVE PINTO
INQUIRED ABOUT HAVING TWO BILLS AT THE
SAME TIME AND THIS IS BEFORE
YOU WERE ELECTED BUT I WAS A
FRESHMAN AND THERE WERE 5 OF US
THAT HAD DIFFERENT
VARIATIONS OF REPEALING THE BUSINESS TO
BUSINESS TAXES THAT HAD BEEN
ENACTED THE YEAR BEFORE AND
FOUND THAT WAS A REALLY BAD
IDEA; THERE WERE 5 OF US THAT
CAME BEFORE THE TAX COMMITTEE
WITH ALL DIFFERENT VARIATIONS
OF IT SO THAT WE CAN ALL BE
HEARD; SOME HAD THE SAME
THING AND THE CHAIR WAS GRACES ENOUGH
TO HEAR ALL OF US. I REMEMBER
SITTING SIDE BY SIDE WITH NOW
SENATOR ISAACSON;
THEN REPATIVE ISAACSON SO IT IS DONE AND IT
ISN'T DONE MAYBE AS OFTEN; BUT
WHEN IT IS REALLY
REALLY IMPORTANT ISSUE LIKE THIS T IS
DONE; SO JUST SO YOU KNOW WHEN
I WAS A FRESHMAN 5 YEARS AGO
NOW THAT DID TAKE PLACE ALSO I
WANT TO REMIND TOO WE HAD A
PRESENTATION; THOROUGH AND
IN-DEPTH PRESENTATION FROM
HOME LAND SECURITY DOING THE
AUDITS SO SINCE YOU ARE NOT MEMBERS OF
THE COMMITTEE; I WANTED YOU TO
HEAR THAT HOME LAND SECURITY
DOES A GREAT JOB DOING THE
AUDITS AND HAD BEEN DOING
AUDITS; THEY HAD DONE I
THINK OVER 100 ODD TDS OF SCHOOLS AND
ASSISTING THEM AND TRYING TO
HARDIN THE SCHOOLS AND
PROVIDE PROTECTION; SO THIS IS
SOMETHING WE TALKED ABOUT EARLY
ON AND I AM GLAD WE ARE
FINISHING UP THE SECOND
DEADLINE WEEK WITH THIS BECAUSE
IT HAS COME FULL CIRCJL GOOD
TO SEE MONEY PUT TO THAT SO THE
SCHOOLS CAN ACTUALLY CHOIR WHETHER IT IS HOME LAND SECURE
OR SOMEBODY ELSE TO COME IN AND
DO A AUDIT. I WAS IN THE MAPLE
LAKES SCHOOL ABOUT THREE WEEKS
AGO WITH A SUPERINTENEDANT
AND HE WANTED TO
TALK ABOUT SCHOOL SAFETY AS A COUPLE OTHER OF MY
PRINCIPLES AND
SUPERINTENDENTS DID AND THEY HAD HAD A CURSORY
AUDIT SO THEY HAD LOCAL LAW
ENFORCEMENT COME IN AND THE
SHERIFF DEPARTMENT COME IN AND
MAKE SUGGESTIONS AND SAID; YOU
KNOW WHAT; THIS DOOR COULD BE
PROPPEDOPEGEN SOMETIME THAIZ
ARE SO IF YOU HAVE A BAD ACTOR
THE BAD ACTOR CAN OPEN UP THE
DOOR AND LET SOMEBODY IN SO YOU
SHOULD THINK ABOUT THAT. YOU
HAVE THE THREE PANELS OF GLASS
DOORS THAT
ARE WHERE PEOPLE COME IN AND THEY CAN EASILY BE
TAKEN OUT AND JUST WALK IN
THERE. HE HAD VERY CONCRETE
THINGS THEY WERE
CONSIDERED TO HARDIN THE SCHOOL AND PROTECT
THE
STUDENTS. THESE ARE-THIS IS THE TIME WE LIVE IN AND I
APPRECIATE YOU BRINGING THIS PR
FRWARD AND I HAVE SEEN
IN MY DISTRICT IN THE LAST MONTH THE
RAISED LEVEL OF CONCERN AND
THEIR ACTION AND RESPONSE TO IT
SO I APPRECIATE YOU GIB THG
SCHOOLS THE TOOL THEY NEED TO
FURTHER HARDIN THE SCHOOLS AND PROTECT THE CHILDREN. THANK
YOU. >> CHAIR: THANK YOU. I MIGHT
ADD ANOKA HENNEPIN HAS BEEN
DOING THIS THE PAST YEAR. WE
PASSED A BOND ISSUE. ALL THE
ISSUEERIZE BEING ADDRESSED AND THIS WILL BE HELPFUL FOR OTHER
SCHOOLS. REPRESENTATIVE
BECKER FINN. I BELIEVE YOU
HAD SOMETHING TO ADD.
>> REPRESENTATIVE BECKER
FIN: THANK YOU; MR.
CHAIR. REPRESENTATIVE JESSUP IS THE
OTHER SIDE OF MY DISTRICT SO WE
SHARE REPRESENTATION FOR PART
OF MOUNTAIN VIEW SCHOOLS AND I
AM A COAUTHOR ON
REPRESENTATIVE JESSUP'S BILL AND THE REASON IS
BECAUSE I THINK THIS IS
THE TIME WE NEED TO COMPREHENSIVELY
ADDRESS THE PROBLEM OF OUR
KIDS BEING SAFE WHILE THEY ARE AT
SCHOOL; AND I AM IN MY SON'S
ELEMENTARY SCHOOL LITERALLY
EVERY DAY WHEN DROP HIM
OFF AND I KNOW WE HAD BONDING
ISSUES ON THE BALLOT LAST YEAR
IN ALL THE SCHOOL DISTRICT JZ
PART OF THE ASK IS SO THEY
COULD DO WORK AROUND THAT. ONE
OF THE REASONS I SIGNED ON TO
YOUR BILL IS BECAUSE IT
INCLUDES THE
CRISIS MANAGEMENT POLICY SO JUST TO-IT IS BROADER
THAN JUST THE
PHYSICAL STRUCTURES; WE HAVE TO HAVE
GOOD POLICIES SO WE ARE
REACTING SAFELY FOR OUR KIDS;
AND I THINK IN ORDER TO DO
THAT; COMPREHENSIVELY WE ALSO
HAVE TO ADDRESS GUNS; NOBODY
SAID THE WORD GUN YET IN
THIS HEARING; BUT THAT IS
REALLY WHAT-WE TALK ABOUT IT
BEING PENETRABLE WE TALK ABOUT THE
FEAR WE HAVE AND THE DESIRE TO
PROTECT OUR KIDS; THAT IS PART
THE PUZZLE TOO; AND WE ARE
NOT GOING TO BE ABLE TO
FULLY PROTECT KIDS TO THE DEGREE THAT
WE WANT TO IF WE ARE NOT
COMPREHENSIVELY DOING THAT AND
REPRESENTATIVE JESSUP YOU
SPOKE TO FEELING SAFE IN
OUR SCHOOLS AND I THINK WE VERY CLEARLY
FROM THE THOUSANDS OF
YOUNG PEOPLE WHO CAME OUT JUST IN THE
LAST COUPLE WEEKS THAT KIDS
DON'T FEEL SAFE IN SCHOOL AND
WE HAVE OUR YOUNG PEOPLE
TELLING US THAT; SO I'M HAPPY
TO SUPPORT THIS BILL AND I
WOULD JUST ENCOURAGE MEMBERS
AND PARTICULARLY
REPRESENTATIVE JESSUP TO LOOK AT ALL ASPECTS
IN HOW WE PROTECT OUR KIDS IN
SCHOOL; BECAUSE WE
ABSOLUTELY DO NEED TO ADDRESS THIS; SO I
THANK YOU FOR BRINGING THIS
FORWARD AND HOPE THAT WE CAN
BROADEN THE SCOPE SO WE ARE
REALLY ADDRESSING THIS PROBLEM
IN A MEANINGFUL WAY AND THE WAY
OUR YOUNG PEOPLE ARE ASKING TO
BE PROTECTED. THANK YOU.
>> CHAIR: THANK YOU
REPRESENTATIVE. THE LAST PERSON WE HAVE ON THE LIST IS
REPRESENTATIVE [INAUDIBLE
COMMENTS] >> TO THE BILL AUTHOR YZ
HAVE A FEW THINGS I WANT TO TALK ABOUT
HERE AND I'M TRY ING TO
UNDERSTAND THE ORDERS. WHEN I
THINK ABOUT $2 MILLION JUST I
THINK IT WAS YESTERDAY IN
CAPITAL INVESTMENT WE HEARD
ABOUT A FUND GRANT PROGRAM
THAT WAS GOING TO SET UP SO THAT
SCHOOLS HAVE THE OPPORTUNITY TO
GET THE MONEY TO ACTUALLY
DO THIS SO THAT IS A GOOD WAY TO
START BUT THAT WAS ONLY $5
MILLION; AND I'M SITTING HERE
AND THINK IF WE DO $2 MILLION
FOR AUDITS; IT'S LIKELY GOING
TO SHOW A WHOLE LOT MORE THAN
$5 MILLION OF NEEDS THAT
WILL BE OUT IN THE SCHOOLS; SO I'M
NOT SURE WE ARE RIGHT ON
THINKING ABOUT THE MONEY AND
IMPLICATION OF HOW
WE WOULD FINANCE THESE TYPE OF PROJECTS;
BUT I ALSO HAVE CONCERN THAT
REPRESENTATIVE BECKER FINN BROUGHT UP AND THAT IS THAT YOU
KNOW; WE ARE LOOKING AT TRYING
TO MAKE OUR SCHOOLS SO
SECURE THAT OUR FEAR OF
ALLEVIATING THE POSSIBILITY OF A
MASS SHOOTER COMING IN AND KILLING
OUR KIDS IS SOMEHOW WE ARE
SATISFIED; AND I WILL USE
RHETORIC THAT DOESN'T COME FROM
ME; IT COMES FROM THE
OTHER SIDE IS BAD PEOPLE WILL ALWAYS
FIND A WAY; AND I THINK WE NEED
TO HAVE THAT AS PART OF OUR
DISCUSSION TO REALIZE WHAT WE
ARE DOING ISN'T
ASSUREING SAFETY AND SECURITY FOR OUR
KID; IT ISN'T INSURING SAFETY
OR SECURITY FOR ANYBODY IF WE
MOVE IT TO MOVIE THEATERS OR
EVENT CENTERS OR THINGS LIKE
THAT AND PART OF IT BECAUSE
GUNS ARE VERY PREVALENT IN OUR
SOCIETY AND AS LONG AS GUNS ARE
PREVALENT IN OUR SOCIETY WE
WILL ALWAYS HAVE INCIDENT LIKE
THIS. I APPRECIATE THAT THE
CHAIR WAS WILLING TO HEAR THIS
BILL AND HAVE THIS
CONVERSATION; BUT THE REASON WE
ARE DOING THIS BILL IS BECAUSE
OF MASS SHOOTINGS; BECAUSE OF
SOME STUDENTS AND AN ADULT
KILLED IN
PARKLAND FLORIDA AND IT WAS BECAUSE OF A GUN; A
SEMI-AUTOMATIC RIFLE BUT YET WE
CAN'T HAVE A HEARING ABOUT
THAT. I THINK THIS IS GREAT; I
THINK WE NEED TO DO THESE TYPE
OF THINGS; BUT ALSO THINK WE
NEED TO HAVE THAT BROADER
CONVERSATION AND UNTIL WE HAVE
THAT BROADER CONVERSATION I
THINK WE ARE JUST PUTTING FALSE
SECURITY WITH PEOPLE OUT THERE
AND WE ARE ABLE TO PAT
OURSELVES ON THE BACK AND SAID
WE DID SOMETHING 6789 WE ARE
REALLY NOT DOING ANYTHING. WE
ARE REALLY TRYING TO MAKE THE
SCHOOLS MORE SECURE BUT WE ALSO
KNOW IF THERE ARE BAD
PEOPLE THEY WILL FIND A WAY; AND IF
THAT'S BEING OUT SOMEWHERE
WHEN KIDS GET OUT OAF SCHOOL TO GET
ON THE BUS; THERE IS A
OPPORTUNITY. ARE WE BUILDING
TUNNELS THAT ARE SECURE FOR THE
KIDS TO LEAVE THE
SCHOOLS TO GET TO THE BUSES AND DO WE MAKE
THE BUSES
IMPENETRABLE? WHAT I'M TRYING TO SAY; IS
THIS A LITTLE PIECE OF A
MUCH LARGER THING AND HOPE WE CONTINUE TO
HAVE THE CONVERSATION ABOUT THE
LARGER THING THAT IS MAKING OUR
CHILDREN IN SCHOOLS VULNERABLE
AND MAKING THEM SCARED AND
PUTTING THEM IN
SITUATIONS WHERE THEY ARE STRESSED. WHEN
KIDS GO THROUGH TRAINING ABOUT
LOCK-DOWN AND
WHAT HAPPENS IF THE IS A SHOOTER IN THE SCHOOL;
I COULDINATE IMAGINE WHAT
THAT WOULD BE LIKE TO BE A KID THAT
IS 8; 9 OR 10
GOING THROUGH THAT AND THEN HAVING TO GO BACK
TO THE CLASSROOM AND LEARN.
SO; I APPRECIATE THESE
BILLS; I THINK THEY ARE A LITTLE BIT OF
A START; BUT THINK WE HAVE A
LONG WAY TO GO.
>> CHAIR: THANK YOU. WE HAVE
ADDED A FEW MORE TO THE LIST
HERE. >>
REPRESENTATIVE GROSSELL: THANK YOU; GENTLEMEN FOR
BRINGING THESE BILLS FORWARD; IT IS A START. IT IS A START.
LIKE EVERYBODY SAID THAT IS A
DROP IN THE BUCKET; ONLY THE
BEGINNING. TO SAY THAT THE END
ALL BE ALL IS TO DO ANYTHING
WITH GUNS; THAT'S JUST ONE
LITTLE PIECE THAT IF YOU DID
ANYTHING WITH THAT LIKE YOU
SAID IT WOULDN'T MAKE A LOT OF
DIFFERENCE; SO WITH THAT
BEING SAID; THERE IS BIGGER
ISSUES THAT WE NEED TO DEAL WITH.
MAKING SCHOOLS SAFE; THAT'S A
PRIORITY. I HAVE BEEN IN LAW
ENFORCEMENT AND PUBLIC SAFETY
FOR MANY YEARS TO TRY TO MAKE
THINGS; PEOPLE SAFE. TRY TO
MAKE COMMUNITIES A BETTER PLACE
TO LIVE. TRYING TO MAKE SURE
THAT THESE KIDS CAN GO TO
SCHOOL UNAFRAID OF DRUG
EDEALERS; UNAFRAID OF PREDATORY
OFFENDERS OF ALL KINDS. PEOPLE
THAT DO THEM HARM WITH WEAPONS;
MY MOLESITATION; VICTIMIZING IN
MANY DIFFERENT WAYS. IF WE GET
ON TRACK AND START DEAL WG THE
REAL ISSUES LOOK AT OUR
SOCIETY; GUNS HAVE BEEN A PART
OF OUR NATION FROM THE
FOUNDATION. THESE MASS MURDERS
ARE THINGS THAT HAPPEN AND THEY
ARE OUTRAGEOUS AND IT HURTS
EVERYONE. IT HURTS EVERYONE.
THERE ARE PEOPLE USING FIRE
ALARMS TO GET PEOPLE TO COME
OUT OF BUILDINGS AND CRASH INTO
WITH A VEHICLE AND SLASH WITH
KNIVES. WE NEED TO TAKE KNIVES
AWAY; AND CARS.
DOESN'T SOLVE IT; DOES IT? THE PROBLEM IS IN
OUR SOCIETY; THE DEGRADATION OF
OUR SOCIETY. QUH I WAS A KID
TO NOW; THE CHANGES I
HAVE SEEN AND BEING IN
LAW ENFORCEMENT BOTH ENDS OF THE SPECTRUM OF
EVIL VERSUS GOOD; YOU GUYS HAVE
SEEN IT AS PROSECUTORS; I
HAVE SEEN IT RAW AND FRESH ON THE
FRONT
LINES. YOUTH MURDERED BECAUSE THEY ARE INVOLVED
WITH GANGS AND DRUGS. RIGHT ON DOWN
THE LINE. THERE IS A LOT MORE
TO DEAL WITH AND GUNS ARE NOT
GOING TO DO IT; MAKE ING THE
KIDS SAFE ISN'T GOING TO FILL
IT ALL EITHER. WE GOT TO GET
THE FOCUS ON WHAT NEEDS TO BE
DONE AND THAT'S A HEART AND
MIND CHANGE IN THIS NATION AND
OF ITS PEOPLE. WE HAVE BEGUN
TO ACCEPT SO MANY THINGS THAT
20 YEARS AGO WERE NOT
ACCEPTABLE; BUT WE KEEP GOING
DOWN HILL. I'M SPEAKING AS A
FATHER; I'M SPEAKING AS A LAW
ENFORCEMENT OFFICER; TRYING TO
KEEP MY KIDS SAFE AND TRYING TO
KEEP YOURS SAFE AS WELL. IF WE
GET OUR FOCUS ON THE RIGHT
PLACE; WE CAN START MAKING
A DIFFERENCE.
>> CHAIR: THANK YOU; MATTE;
MATT; REPRESENTATIVE WARD; BELIEVE YOU HAVE THE LAST WORD
ON THE
SUBJECT. >> REPRESENTATIVE WARD: THANK
YOU; MR. CHAIR; I APPRECIATE
BEING RECOGNIZED. I WAS PART
OF SEVERAL SCHOOL DISTRICTS IN
THE EAST METRO AREA THAT MET
WITH TRAINERS-I DON'T REMEMBER
WHETHER IT WAS HOME LAND
SECURITY OR THE EQUIVALENT OF
THAT; EXPERTS COMING FROM THE
NATIONAL ORGANIZATIONS AFTER
COLLIN BINE SO WE HAD HUGE
ROOMS OF
EDUCATORS; ADMINISTRATORS; TEACHERS AND
SOME STUDENTS GOING THROUGH A
CONVERSATION ABOUT WHAT
HAPPENED AT COLUMBINE AND
WHAT SCHOOLS NEEDED TO DO AND THAT
WAS PART THE ASSESSMENT SO IT
IS ONGOING AND IT IS A PIECE OF
A EVOLUTION. THIS IS A PART OF
THE PUZZLE; A LARGE PUZZLE THAT
HAS A LOT OF PIECES THAT WE
HAVE IN SOME CASES NEGLECTED.
ONE IS SCHOOL COUNSELORS AND
OTHER IS SUPPORT SERVICES FOR
STUDENTS; SERIOUSLY LACKING IN
OUR SCHOOLS. ALL OF
OUR SCHOOLS. WE HAVE A VIOLENT
CULTURE; AND THAT'S ONE OF THE
THINGS I AGREE REPRESENTATIVE
GROSSELL WE REALLY NEED TO
ADDRESS. PART OF THE PUZZLE.
HEALTHCARE; MENTAL
HEALTH SERVICES; SOME KNOW
MY YOUNGER SON IS A ER DOCTOR AND WE HAD
CONVERSATIONS ABOUT A SHIFT
DOESN'T GO BY BUT HE HAS
SOMEONE COMING IN WITH
REACHING THE BOTTOM WHETHER THEY ARE
DEPRESSED OR WHETHER THEY HAVE
AN ADDICTION PROBLEM; AND
THEY WANT HELP; AND HE CAN'T DO
ANYTHING BECAUSE THERE ARE NO
BEDS. IF THEY ARE REALLY DRUNK
OUT OF THEIR MINDS HE CAN HOLD
THEM 24 HOUR JZ HOPEFULLY THEY
WILL GET SERVICES AS THEY
SOBER UP THEY WILL BE IN A
POSITION WHERE THEY CAN ASK FOR HELP;
AND IF THEY GOT
MONEY SOMEHOW THERE WILL BE A BED THAT WILL
TAKE THEM; THEY WILL FIND A
BED; BUT THEY HAVE
TO HAVE MONEY; THEY HAVE TO HAVE CASH
OR HAVE TO HAVE INSURANCE THAT
WILL COVER THEM. AND WE ARE
MISSING ALL OF THOSE PEOPLE.
THEY ARE DROPPING THROUGH THE
CRACKS BECAUSE WE DON'T PROVIDE
THE SERVICES THAT THEY NEED SO
IT IS BIGGER PROBLEM THAN
THE SCHOOLS; BUT I HAVE ONE
QUESTION; A DIFFERENCE BETWEEN
THESE TWO BILLS AND THOUGHT WE
ARE HEARING THIS
UNEDUCATION; WHY IS IT IN PUBLIC SAFETY?
ONE SAYS PUBLIC SAFETY AND ONE
SAYS EDUCATION; DEPARTMENT OF
EDUCATION; DEPARTMENT OF PUBLIC
SAFETY. ARE WE ASKING FOR
MONEY FROM BOTH OF
THESE AGENCIES OR IS IT LAID OVER
HERE; IT IS IN PUBLIC
SAFETY BUDGET? AND Y WOULD LIKE TO
CLAR IFICATION ON THAT PLEASE.
>> CHAIR. TO THE
TESTIFIERS WHO WANTS TO TAKE THAT ONE?
>> REPRESENTATIVE JESSUP: MR.
CHAIR AND ROPET
ATIVE WARD; I WOULD SAY AT THIS POINT IT WILL
BE LAID OVER AND
PROBABLY DISCUSSED BETWEEN CHAIR OF YOUR
COMMITTEE AS WELL AS THE CHAIR
OF EDUCATION FINANCE TO
DETERMINE WHERE SHOULD THIS
BEST FIT. I DON'T COME BEFORE
YOU AND SAY I HAVE THE ANSWER
TO YOUR QUESTION; BUT I
ANTICIPATE THAT IF THIS
COMMITTEE AGREES YES THIS IS
THE RIGHT INITIATIVE TO MOVE
FORWARD; EDUCATION FINANCE SAID
YES WE BELIEVE THE IS
INITIATIVE TO MOVE FORWARD. WE
HAD SIMILAR HEARINGS IN THE
SENATE AT SOME POINT IT WILL BE
PUT INTO ONE OF THE TWO
COMMITTEES ON THE BILLS.
>> CHAIR: THANK YOU. WAS
THERE ONE SMALL [INAUDIBLE
COMMENTS] >> I WANT TO ASK;
REPRESENTATIVE WARD POINTING OUT THE DIFFERENCE BETWEEN THE
BILLS MADE
ME NOTICE REPRESENTATIVE [INAUDIBLE
COMMENTS] I ASSUME IS REAL
APPEALING TO ALL SO I WONDER IF
REPRESENTATIVE
CHRISTENSEN COULD IF AS THE BILL GETS
MERGED FORWARD IF THAT IS
SOMETHING YOU ANTICIPATE SUPPORTING TO MAKE SURE THE
LANGUAGE DOES INCLUDE THE
LANGUAGE IN
REPRESENTATIVE JESSUP'S BILL BUT TAKING A LOOK
THAT FULL SECURITY PICTURE FOR
THE SCHOOLS THAT INCLUDE THE
CRISIS MANAGEMENT POLICY.
>> REPRESENTATIVE
CHRISTENSEN: I ABSOLUTELY SUPPORT THAT
LANGUAGE WE JUST DRAFTD
DIFFERENTLY. >> CHAIR: ANYONE FROM THE
PUBLIC THAT WOULD LIKE TO OFFER
TESTIMONY ON EITHER OF THESE
BILLS? OKAY; SEEING NONE-CHAIR
WILL MOVE THAT HOUSE FILE 3885
LAID OVER
FOR POSSIBLE INCLUSION IN THE
OMNIBUS BILL; AND HOUSE FILE 3676 WILL BE
LAID OVER FOR POSSIBLE
INCLUSION ALSO. THANK YOU FOR
YOUR TESTIMONY.
ANYTHING ELSE? ALRIGHT; THANK YOU FOR COMING
AND WE'LL
ADJOURN. [MEETING ADJOURNED]
